Planning & Zoning Board
October 11, 2006
Page 2
A. CONTINUED PUBLIC HEARING for a Rezoning, MUSA Allocation,
Variances and Preliminary Plat for Golden Acre
Mr. Bengtson stated that this item was continued from the September 13, 2006 meeting.
Mr. Bengtson presented the staff report and noted that the property is guided for low
density sewered residential and was incorrectly stated in the staff report. Staff
recommended approval of the request subject to ten recommended conditions as listed in
the staff report, including an amendment to condition no. 9 to add "unless the city
forester approves the substitution of a preservation - worthy tree that exists on the site."
Mr. Pogalz asked if this area has storm sewer. Mr. Studenski replied that the storm sewer
in this area is only in the streets and is minimal at that. He added that there is storm
sewer in the Hailey Manor development to the east. He explained that the drainage flows
to the east to the pond at Hailey Manor and then enters the storm system. Mr. Pogalz was
concerned about the ongoing maintenance of rain gardens. Mr. Studenski stated that the
amount of flow into this area will be minimal
Mr. Tralle opened the Public Hearing at 6:33 p.m.
Applicant, Tim Anderson, 547 Lois Ln., stated that there are numerous mature trees on
his site and he would like to contact the city forester in regards to adequate tree
preservation. City Staff agreed to put the applicant in contact with the City's
Environmental Specialist Marty Asleson.
Mr. Rafferty asked if the applicant is trying to maintain the majority of the trees. Mr.
Anderson explained that a number of trees will have to go due to house pads, but he
would like to arrange driveway locations to minimize loss of trees on the site.
Mr. Pogalz made a motion to close the Public Hearing at 6:45 p.m. Motion was
supported by Mr. Laden. Motion carried 5 - 0.
Mr. Pogalz made a MOTION to recommend approval of the Rezone, MUSA Allocation,
Variances and Preliminary Plat for Golden Acre with the following ten conditions:
1. All lots in the plat, including the existing home, must agree to connect to City
utilities. The City will not approve the final plat without legally enforceable
assurance that all properties will connect and existing onsite septic systems will be
appropriately abandoned.
2. Existing wells shall be capped when required by Minnesota Dept. of Health
requirements.
3. Issues discussed in the City Engineer review memo must be addressed to his
satisfaction.
4. A development agreement between the city and the developer must be executed prior
to the issuance of any building permits for the site.
DRAFT MINUTES
