CONTINUED PUBLIC HEARING for a Rezoning, MUSA Allocation, <br />Variances and Preliminary Plat for Golden Acre <br />Mr. Bengtson stated that this item was continued from the September 13, 2006 meeting. <br />Mr. Bengtson presented the staff report and noted that the property is guided for low <br />density sewered residential and was incorrectly stated in the staff report. Staff <br />recommended approval of the request subject to ten recommended conditions as listed in <br />the staff report, including an amendment to condition no. 9 to add "unless the city <br />forester approves the substitution of a preservation - worthy tree that exists on the site." <br />Mr. Pogalz asked if this area has storm sewer. Mr. Studenski replied that the storm sewer <br />in this area is only in the streets and is minimal at that. He added that there is storm <br />sewer in the Hailey Manor development to the east. He explained that the drainage flows <br />to the east to the pond at Hailey Manor and then enters the storm system. Mr. Pogalz was <br />concerned about the ongoing maintenance of rain gardens. Mr. Studenski stated that the <br />amount of flow into this area will be minimal <br />Mr. Tralle opened the Public Hearing at 6:33 p.m. <br />Applicant, Tim Anderson, 547 Lois Ln., stated that there are numerous mature trees on <br />his site and he would like to contact the city forester in regards to adequate tree <br />preservation. City Staff agreed to put the applicant in contact with the City's <br />Environmental Specialist Marty Asleson. <br />Mr. Rafferty asked if the applicant is trying to maintain the majority of the trees. Mr. <br />Anderson explained that a number of trees will have to go due to house pads, but he <br />would like to arrange driveway locations to minimize loss of trees on the site. <br />Mr. Pogalz made a motion to close the Public Hearing at 6:45 p.m. Motion was <br />supported by Mr. Laden. Motion carried 5 - 0. <br />Mr. Pogalz made a MOTION to recommend approval of the Rezone, MUSA Allocation, <br />Variances and Preliminary Plat for Golden Acre with the following ten conditions: <br />1. All lots in the plat, including the existing home, must agree to connect to City <br />utilities. The City will not approve the final plat without legally enforceable <br />assurance that all properties will connect and existing onsite septic systems will be <br />appropriately abandoned. <br />2. Existing wells shall be capped when required by Minnesota Dept. of Health <br />requirements. <br />3. Issues discussed in the City Engineer review memo must be addressed to his <br />satisfaction. <br />4. A development agreement between the city and the developer must be executed prior <br />to the issuance of any building permits for the site. <br />DRAFT MINUTES <br />
