Park dedication must be paid in accordance with the city's fee schedule. <br />7. A permit from the Rice Creek Watershed District must be issued prior to final plat <br />approval by the City. <br />8. Infiltration areas proposed on site should have the City native seed specification used. <br />9. A boulevard tree shall be provided for each lot frontage unless the city forester <br />approves the substitution of a preservation -worthy tree that exists on the site. <br />10. A tree inventory and preservation plan must be submitted to the city prior to any <br />construction on the site. <br />Motion was supported by Mr. Rafferty. Motion carried 5 - 0. <br />B. Final Plat for Junes Addition, 599 — 62nd Street <br />Mr. Bengtson presented the staff report. Staff recommended approval with no <br />conditions. <br />Mr. Rafferty made a MOTION to recommend approval of the Final Plat for Junes <br />Addition. Motion was supported by Mr. Nelson. Motion carried 5 - 0. <br />C. Planned Unit Development Final Plan for Legacy Townhomes 2nd Addition, <br />Legacy at Woods Edge <br />Mr. Bengtson presented the staff report. Staff recommended approval with conditions as <br />listed in the staff report. <br />Mr. Rafferty made a MOTION to recommend approval of the Planned Unit Development <br />Final Plan for Legacy Townhomes 2nd Addition subject to the following conditions: <br />1. The developer will enter into a development agreement with the city prior to the <br />issuance of any building permits for the site. This agreement shall clearly require that <br />the conditions of Resolution 06 -119 still apply to this site. <br />2. The vacation of drainage and utility easements on Outlot B of Village No. 3 must be <br />approved and recorded prior to this final plat being recorded. <br />Motion was supported by Mr. Laden.
