Mr. Laden asked what their purpose was for originally acquiring <br />the land. Mr. Tschida explained that there is a pump in Centerville Lake as well as the <br />dam and that owning the property would help them to manage the flow of the lake. <br />Mr. Nelson made a MOTION to recommend approval of the Variances for Road <br />Frontage, Lot Area, Lot Width, and Lot Depth, for properties along Peltier and <br />Centerville Lakes as described in the staff report. Motion was supported by Mr. Rafferty. <br />Motion carried 6 - 0. <br />E. Preliminary Plat and Variances for Front Setback and Upland Area for Fran's <br />Estate, Birch Street — discussion only <br />Mr. Bengtson presented the staff report and noted that this item was being presented <br />tonight for discussion only as staff was still in the process of reviewing recently <br />submitted material and were not prepared to make a recommendation at this time. <br />Staff noted that since preparing the staff report, the surveyor has agreed to work with <br />staff's concerns. He said that the surveyor had submitted a revised Preliminary Plat that <br />showed a shared driveway, an easement buffer and revised building pads. <br />At this time, staff is asking the board for comments on the issues presented. <br />Mr. Rafferty was concerned that if this variance request was granted, it could potentially <br />set precedence for future applications. He added that this parcel is really one lot not two. <br />Mr. Laden asked for clarification of what the intent is for the amount of upland square <br />footage in the ordinance. Mr. Bengtson replied that the intent is to provide enough room <br />for a buildable lot while allowing for setback requirements from the building pad. <br />Mr. Nelson asked if the revised plan included a decreased setback. Mr. Bengtson replied <br />that the new plans show a smaller building pad to allow for a greater setback area. <br />Upon discussion, board members commented that the property is not large enough to <br />allow for two houses with the limited amount of upland. <br />Mr. Laden wondered if a duplex would fit within the density. Mr. Smyser stated that the <br />Comprehensive Plan restricts R -2 to medium density. <br />Board members commented that the large percentage variance request was excessive. <br />Chuck Plowe, Plowe Engineering, 6776 Lake Dr., representing the applicant, stated that a <br />lot of work and research was done on this project, including working with the Rice Creek <br />Watershed District. Mr. Plowe agreed that the request is for a large variance amount, but <br />that the back lot line was not an issue. He noted that at one time the city did anticipate <br />two lots, as there are two sanitary sewer services in place. He explained that at one time <br />these lots had suitable upland area, but a highway plat removed 10 feet from each lot. He <br />DRAFT MINUTES <br />
