Planning & Zoning Board <br />October 11, 2006 <br />Page 6 <br />stated, therefore, that he is now left with a huge wetland in back and that the highway <br />took away lot frontage area. <br />Mr. Plowe pointed out that there is a home to the east which is 35 ft. from the edge of the <br />roadway, while they are proposing a 30 foot setback. <br />Mr. Root asked for details on the highway taking the land, wondering if the other homes <br />existed at this time. It was confirmed that the other homes were existing. <br />Mr. Root stated that the Board has to judge an application based on the current <br />regulations, and not what has occurred previously. <br />Mr. Nelson commented that it is an extenuating circumstance to look at surrounding <br />homes and their setbacks, and that it warrants consideration to look at neighboring <br />homes. <br />Mr. Laden stated that this application has considerations, but he struggles with the front <br />yard setback reduction. <br />Fran Tourville, 6948 Lake Drive, informed the board that when the city put in sewer, they <br />agreed to hook up sewer for two lots. Mr. Tourville stated that he had no idea at that time <br />they would remove ten feet from the properties. He stated they would have fought the <br />hookup if he had foreseen what was going to happen. He noted that he used to help out <br />the city without charges because he lived here, and he is unhappy about the situation he is <br />in now. <br />Mr. Tralle stated that this is a unique situation that needs to be dealt with but with <br />concern for setting precedence for others. <br />Mr. Tourville stated that due to the depth of the lots, each lot would be almost one acre. <br />Mr. Bengtson explained that the neighboring home may have to be purchased by the <br />County if the road widens in the future, and that allowing these variances now could <br />create a problem in the future. <br />Mr. Laden addressed the building pads and asked what the dimensions were. Mr. <br />Bengtson noted the proposed dimensions for each pad. <br />Mr. Laden asked if the applicant would allow for a smaller building pad in order to <br />increase the setback. Mr. Plowe stated it is possible. <br />Mr. Rafferty commented that a unique building situation could make the difference <br />between one and two lots. <br />Mr. Bengtson stated that staff would consider the comments of the board and would bring <br />the application before the board at the November meeting as a Public Hearing. <br />DRAFT MINUTES <br />• <br />• <br />• <br />
