Planning & Zoning Board <br />November 8, 2006 <br />Page 3 <br />Mr. Tralle opened the Public Hearing at 7:03 p.m. <br />Bruce Schmidt, 6498 Totem Trail, asked what the applicant was proposing to do with the <br />ditch that was between their properties. <br />Mr. Tourville replied that he had proposed extending the culvert 80 feet to the south and <br />filling it in so the lots would be even. He added that if the city were to have a <br />maintenance problem with that then it would remain the same. <br />Mr. Nelson asked Mr. Schmidt if he had concerns about the proposal for the ditch. Mr. <br />Schmidt replied that he somewhat likes the ditch and was just wondering about it. <br />Polly Greve, 6469 Tomahawk Court, stated that her property borders the applicant's in <br />the southeast corner and was concerned about wetland fill. She commented that she <br />already has problems with water in her yard, and because she is downhill from the <br />applicant she is worried about increased drainage problems to her property. She asked <br />what options she had if problems were to occur. Mr. Studenski responded that 400 feet <br />of fill would have a very minimal impact and that this amount would not affect drainage. <br />Ms. Greve asked what would happen if the problem did make it worse. Mr. Studenski <br />replied that the city would look into the ditch area to determine the problem. <br />• Board members discussed the potential increase in upland area by filling in 400 feet. <br />Staff noted that the proposed changes could alleviate some of the situation, but that they <br />could not make comment or recommendation on proposals without seeing plans. <br />Mr. Laden asked if the proposal could be approved by adding conditions. Mr. Bengtson <br />stated that they could add the changes to the conditions of approval, but there would be <br />no confirmation that these things recommendations were adhered to by the council. <br />Mr. Laden asked the applicant when he plans on starting construction. Mr. Tourville said <br />that he is wide open, probably next spring, adding that he is in no hurry. <br />Mr. Rafferty noted that the proposal does not meet ordinance requirements and approval <br />could set precedence for the future. <br />Board members determined that because two board members were absent and not all <br />members present were in favor of the proposal, it may be in the applicant's favor to come <br />back with revised plans. <br />Dennis Schwartz, 6471 Tomahawk Court, questioned how the houses would fit on to the <br />lots. He wondered how far back on the property the houses would be. He added that his <br />property is a sponge and wondered how this would affect his property. Mr. Tralle replied <br />that according to the city engineer this proposal should not affect his property. <br />Board members asked the applicant if he would like the board to vote on the item or if he <br />would prefer to come back to the next meeting with revised plans.
