• <br />• <br />• <br />Planning & Zoning Board <br />August 10, 2011 <br />Page 3 <br />Mr. Smyser distributed photos of the area proposed for a new commercial zoning district. <br />He described some of the existing businesses that are located in the areas of Orange <br />Street and Maple Street. <br />Staff has considered which commercial uses might be appropriate for this area of the city. <br />Mr. Smyser noted that one of the auto repair shops has requested to sell cars on the site, <br />which is not currently allowed per the property's current zone. In addition, a new <br />property owner in the area is running a business that is not currently allowed. Board <br />Members commented that ignorance of the rules does not give rights to a property owner. <br />Staff clarified that the action by the board is to amend the to ° the zoning ordinance by <br />creating a new business zone. No properties will be rezoned at time. A future public <br />hearing will be held with notices to all of the aff , .property owners when staff <br />prepares to rezone properties to the new zoning. istrict. <br />Mr. Pogalz made a MOTION to close the Public Hearing at 7:41 p.m. Motion was <br />supported by Mr. Hyden. CONTINUED PUBLIC HEARING to consider Amending the Conditional Use <br />Permit for =aotor fuel station to allow for the installation of new gas pumps <br />and canopy, ted at 7997 Lake Drive <br />City Planner, Jeff Smyser, presented the staff report. <br />it Tralle declared the Public Hearing open at 7:42 p.m. <br />Therevas no one present to speak. <br />Mr. Smyser noted that staff met with the project applicant and a complete application is <br />expected before the next meeting. <br />Mr. Pogalz made a MOTION to continue the Public Hearing to the next meeting at 7:43 <br />p.m. Motion was supported by Mr. Hyden.
