PLANNING & ZONING BOARD <br />AGENDA ITEM 5A <br />STAFF ORIGINATOR: Michael Grochala <br />P & Z MEETING DATE: February 13, 2013 <br />REQUEST: Final Plat Approval, Rademacher Additions <br />Case No. FP2013 -001 <br />APPLICANT: Grant Rademacher <br />Rademacher Family Partnership, LLP <br />REVIEW DEADLINE: Application Deemed Complete - January 18, 2013 <br />60 - Day Review Deadline - March 19, 2013 <br />BACKGROUND <br />The City Council approved the preliminary plat for Rademacher Addition, formerly <br />known as Bill's Superette on December 10, 2012 with Resolution No.12 -129. <br />Radamacher Additions is a 2 -lot commercial subdivision on the NE corner of Lake Drive <br />and Main Street. The City Council approval included the following conditions: <br />1) A trail is installed along both Lake Drive and Main Street; <br />2) Cross access easements are submitted and approved by city staff to allow both <br />businesses to utilize both accesses; <br />3) Obtain all necessary permits from the Rice Creek Watershed District, and provide <br />a copy of that permit to the city; <br />4) Pond areas must be planted with a native seed mix acceptable to the city and <br />managed for a minimum of three years by an approved city contractor; <br />5) Execution of a Stormwater Operation and Maintenance Agreement between the <br />City and/or RCWD prior to issuance of a building permit; <br />6) All outstanding land use fees or escrows shall be paid in full prior to issuance of a <br />building permit; <br />7) Title work satisfactory to the City Attorney shall be submitted and reviewed prior <br />to final plat recording; <br />8) A development agreement is entered into between the City and the Developer as <br />part of the final plat approval process; <br />9) All development fees shall be calculated according to the fees in effect at the time <br />of the final plat; <br />10) Preliminary plat approval shall be valid for one year from the date of this <br />approval.
