A variance shall not be granted for any use that is not allowed under the ordinance for <br />property in the zoning district where the subject site is located. <br />Single family homes are permitted uses in the R -2, Two Family zoning district. <br />g. In accordance with MN Stat. 462.357, Subp. 6, variances shall be granted for earth <br />sheltered construction as defined in MN Stat. 216C.06, Subd. 14, when in harmony with <br />the zoning ordinance. <br />Not applicable. <br />RECOMMENDATION <br />The City Engineer reviewed the plans and has no issues. Staff recommends approval of <br />the preliminary and final plat of Marshan Meadows Second Addition with the following <br />conditions: <br />1. All comments from the RCWD letter dated November 7, 2013 shall be addressed. <br />2. A Development Contract shall be drafted by the City, executed by the City and <br />the owner and recorded with Anoka County. <br />3. An up -to -date (within 3 months) title insurance commitment for the property <br />being subdivided shall be provided. <br />4. Prior to issuance of a building permit <br />a. The final plat and Development Contract shall be recorded with Anoka <br />County. <br />b. A building permit shall be submitted and approved. <br />c. A grading and drainage plan shall be submitted to the City Engineer and <br />Rice Creek Watershed District for review and approval. <br />5. One (1) boulevard tree shall be required on Lot 2, Block 1. <br />6. Revisions to Plan Sheet PP -1 -Cover Sheet <br />a. Zoning shall be revised from R -1 to R -2, Two Family Residential District <br />b. Rear setback shall be revised from 30 feet to 25 feet. <br />7. Revisions to Plan Sheet PP- 2- Resource Inventory /Certificate of Survey <br />a. Zoning shall be revised from R -1 to R -2, Two Family Residential District <br />b. Front and Rear setback shall be revised from 30 feet to 25 feet. <br />8. Revisions to Plan Sheet PP- 3- Preliminary Plat <br />a. Zoning shall be revised from R -1 to R -2, Two Family Residential District <br />b. Rear setback shall be revised from 30 feet to 25 feet. <br />c. Impervious surface calculations shall be provided for existing conditions <br />on Lot 1. <br />d. Impervious surface calculation shall be provided for proposed conditions <br />on Lot 2. <br />e. Under Development Data, Density shall be revised from 0.52 lots /acre to <br />1.69 units /acre. <br />f The buildable area (square feet) of Lot 2, Block 1 shall be provided. (This <br />is the portion of a lot remaining after yards have been provided.) <br />
