AGENDA ITEM VI B <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: January 9, 2008 <br />TOPIC: Public Hearing (Continued): <br />Conditional Use Permit: Planned Unit Development <br />Preliminary Development Plan/Preliminary Plat <br />Conditional Use Permit: Motor Fuel Station <br />Conditional Use Permit: Car Wash <br />Conditional Use Permit: Outdoor Dining (Coffee Shop) <br />Main Street Village, Azure Properties <br />BACKGROUND <br />The proposal by Azure Properties is a planned unit development (PUD) called Main Street <br />Village. The proposal includes creating four commercial lots on a portion of 28 acres of <br />property at the southeast quadrant of the I -35E interchange at Main Street. Development on <br />the remaining 19 acres has not been designed. However, because of stormwater and <br />transportation planning needs, the use of the entire site must be considered. <br />The zoning ordinance defines two types of PUD: rezoning and conditional use permit. A <br />commercial PUD can be approved as a conditional use permit. <br />The site is within the area analyzed by the I -35E Alternative Urban Areawide Review <br />(AUAR). The AUAR's mitigation plan requires some information and review criteria that <br />typically are not applied to development projects elsewhere in the community. <br />Issues From December 12, 2007 Report <br />The P & Z opened the public hearing on the project at the December 12, 2007 meeting and <br />continued it. The staff report for that meeting listed a number of unresolved issues. City staff <br />had instructed the applicant not to submit new plan sheets with the revised layout of parking <br />and circulation until staff had met with county highway department staff. However, a number <br />of other items could have been addressed in the interim. <br />On January 2 staff contacted the applicant about these issues. We then received some new <br />information late afternoon on Thursday, January 3. The new report for the January 9 meeting <br />had to be assembled, printed, and distributed to the Board on January 4. This did not allow <br />time for City staff to review the new information completely. Depending on the information <br />submitted, it may be possible to resolve some of the items on the list. However, it is unlikely <br />that staff will be able to recommend approval of the project on January 9. <br />We are facing statutory deadline pressure. The February P & Z meeting is February 13. This <br />leaves only one City Council meeting, February 25, before the deadline of March 1. The <br />
