Temporary Commercial Stands/ Farmer's Markets <br />This would include anyone selling a product that is not grown on the site, or is not <br />accessory to the principal use occurring on the site. These would have to be temporary <br />events, or the `Open Sales Lot' information in number 4 would apply. <br />a. Licensing Issues <br />Selling fresh produce does not require a license. A license is needed for <br />anything other than fresh produce. Any vendor that sells processed food needs a <br />license from the Minnesota Department of Health, Anoka County, or the <br />Minnesota Department of Agriculture. Determining which body issues the <br />license is not intuitive. <br />b. Site Planning Issues <br />• Parking: The City currently requires all commercial businesses to have <br />off - street parking. If a parking lot is used for selling things, the off - street <br />parking is used up. The likely location of these types of uses will be <br />County Roads, and on- street parking would be limited to side streets and <br />may cause visibility issues. <br />• Waste removal: Waste removal would need to be addressed. <br />• Rest room facilities: This is an issue of providing facilities to serve the <br />vendors and employees more than to serve customers. <br />• Access and Circulation: Access to the site and circulation within the site <br />for emergency situations must be considered. <br />• Life /Safety Codes: There may be other issues regarding building or <br />electrical codes, such as the need for electrical power. Our Building <br />Dept. staff should be consulted. <br />• Zoning/Permitting: We would need to amend official controls to <br />accommodate this type of sales activity. At the minimum some sort of <br />permit should be required for temporary sales, while an organized, <br />regularly occurring farmer's market could require a conditional use <br />permit. A special event permit could be required through the City Code. <br />Staff is seeking any comments or direction from the Board prior to creating draft ordinance <br />language. <br />
