• <br />• <br />AGENDA ITEM VI B <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: January 12, 2000 <br />TOPIC: Thomas McDonough, 25 Ash Street, Minor Subdivision <br />And Variance <br />DESCRIPTION OF REQUEST: <br />Mr. Tom McDonough is the owner of two parcels of property in the south /west corner of <br />the City. Parcel 1A contains 2.47 acres and a single family home, Parcel 2A contains <br />2.82 acres, the total site is 5.29 acres. The City's Zoning Ordinance requires a minimum <br />of 10 acres as the property is Zoned Rural, guided rural in the existing land us plan and <br />located outside the MUSA boundary. However, both parcels are considered pre- existing <br />non- conforming lots of record. The vacant parcel is buildable as it exists. The draft <br />comprehensive plan guides the area for residential and the specific parcels for medium <br />density residential. <br />Mr. McDonough is asking for a minor subdivision that would allow the sale of the <br />existing home on a one acre lot with the combination of the balance of the site and <br />potential sale of that parcel as a 4.24 +/- acre parcel. There is a large wetland on the <br />north /west corner of the property which would not preclude any future construction on <br />that parcel. The surrounding property is described as follows: <br />East side <br />North side <br />South side <br />West side <br />- one 39,000 sq. ft. lot with a SF home, unsewered <br />- three 45,000 sq. ft. lots with SF homes, unsewered <br />- sewered residential development in Shoreview <br />- large wetland adjacent to sewered residential development <br />in Circle Pines <br />A feasibility study was prepared by the City in 1997 to determine the cost of extending <br />utilities to this property and others on Baldwin Lake Road. At that time 34 units were <br />proposed for this site. No further action has been taken on this extension. It would be <br />cost prohibitive to extend utilities to this property without a substantial redevelopment of <br />the site. <br />The Zoning Ordinance provides "Habitable single family homes constructed prior to July <br />13, 1992 may reduce their lot size to a minimum of one (1) acre if the balance of the <br />property results in a parcel of ten (10) acres, or is serviced by public sewer...." Although <br />this division will not create a parcel 10 acres in size, it will provide a larger parcel than <br />currently exists which is more in keeping with the intent of the ordinance. <br />
