• <br />• <br />AGENDA ITEM V. A <br />STAFF ORIGINATOR: John Powell, City Engineer <br />P & Z MEETING DATE: July 12, 2000 <br />TOPIC: PUBLIC HEARING, G.M. Development, Apollo Business <br />Center, Conditional Use Permit - Grading <br />BACKGROUND: <br />G.M. Development (Gary Uhde) is developing an area known as the Apollo Business <br />Center located east of Jon Avenue, between the 74th Street alignment and I -35W. Maps <br />showing this area are attached. Within this area; the Blue Heron and Contract Hardware <br />sites have been developed, the H & L Mesabi site plan has been approved for <br />development, and the Twin City Fab (parcel D) and Marmon /Keystone (parcel E) sites <br />have submitted site plans for review. <br />Trunk sanitary sewer and water provided service to this area of the City about 10 years <br />ago. Construction of Apollo Drive through this site was completed in 1992/93. Apollo <br />Drive was constructed through a Joint Powers Agreement with Anoka County and was <br />designed to comply with county and State Aid design standards. To accommodate <br />proper design of the storm sewer system, the roadway had to be raised above the <br />surrounding elevations. <br />In order to provide fill to be sold to the Apollo Drive contractor, borrow pits were created <br />in the Apollo Business Center. It was expected these pits would later be utilized as <br />storm water pond sites. In order to modify the location of the excavations, and to <br />provide fill for the proposed building sites on parcels D and E, the developer expects to <br />move in excess of 80,000 cubic yards of material. Section 12.B of the City's Zoning <br />Ordinance states 'When five thousand (5,000) or more cubic yards of material is to be <br />removed or deposited on any lot or parcel, a conditional use permit shall be required ". <br />The proposed grading plan includes fill, excavation, storm sewer construction, and <br />wetland alteration. Rice Creek Watershed District (RCWD) is the LGU in this part of the <br />City and has the responsibility for reviewing the proposed wetland alterations. <br />Any alterations to the proposed grading plan will affect existing building sites and the <br />proposed Twin City Fab and Marmon /Keystone sites. The grading plan must mesh <br />exactly with the proposed site plans for the proposed developments. <br />Since the original application submittal, the City has received multiple plan revisions and <br />additional information. Staff attempted to assemble sufficient information on the <br />proposed grading plan, and the two site plans, to prepare a complete report. <br />Unfortunately, we were unsuccessful. We are therefore recommending continuing the <br />public hearing to the August Planning and Zoning meeting. <br />The following comments are based on the latest available information: <br />1. The Environmental Board considered this application at their May 31, 2000, meeting. <br />A copy of the draft minutes of their meeting is attached. <br />2. The proposed discharge rates for the 1, 10, and 100 -year storms may not exceed the <br />existing discharge rates for the 1, 10, and 100 -year storms. <br />
