The property owner at 8255 Lake Drive <br />has a "flag lot" with 2.35 acres and has agreed to sell this triangular parcel to the <br />applicant. The applicant's parcel is .72 acres in size and the driveway is located on the <br />northerly side of the 50 -foot strip of property. Staff noted the location of the mature trees <br />and septic system and recommended approval of the minor subdivision with the four <br />conditions outlined in the staff report. <br />Chair Schaps asked the applicant if he would like to make comment. <br />Steve Benesch, applicant, stated his neighbor is in full support of this request. It was <br />noted that Dave Stoppelman was present in the audience to comment, if needed. <br />Ms. Lane made a MOTION to approve the request of Steve Benesch for a minor <br />subdivision at 8251 Lake Drive that would add a 1,777 square foot triangle (24' x 144') <br />to his existing parcel of property in order to correct an encroachment onto the neighbor's <br />property, with the following conditions: <br />1. Steve Kraus, 8025 W ck Trail, Variance <br />Staff presented the application by Steve Kraus for a variance to allow the construction of <br />a 40' x 40' (1,600 sq. ft.) detached garage in front of his home at 8025 Wood Duck Trail. <br />The property is zoned Rural and guided for low- density unsewered residential <br />development in the draft Comprehensive Plan. According to the Zoning Ordinance, Mr. <br />Kraus is allowed a total of 3,600 square feet of accessory building space on his 3.25 <br />acres. Construction of this proposed structure will bring his total accessory building <br />space to 2,384 square feet which is well within the requirements of the Ordinance. The <br />Zoning Ordinance also provides that "No detached accessory structure shall be closer to <br />the front lot line than the principal building or its attached garage." Thus, the variance <br />requested is to allow the accessory building in front of the principal building. Staff <br />pointed out the location of the trees on this lot and presented the rationale required to be <br />found when considering a variance. Staff advised that Wood Duck Trail was added to the <br />MSA system so if reconstructed to those standards, an additional ten feet of right -of -way <br />would be needed at that time. Thus, the request for the garage to be relocated an <br />additional ten feet towards the west.
