• <br />UDOR Site Plan <br />December 13, 2000 <br />page 2 <br />The two rural zoning districts include the following under accessory uses: <br />Tool houses, sheds and similar buildings for storage of domestic and farm <br />supplies, and non - commercial recreational equipment. <br />All seven residential zoning districts include the following under accessory uses: <br />Tool houses, sheds and similar buildings for storage of domestic supplies and <br />equipment. <br />The General Industrial district does not include accessory buildings in the list of <br />accessory uses. That is, accessory buildings are not listed in the GI district whereas <br />accessory buildings are specifically listed in several other zoning districts. In the past, <br />City staff have informed businesses that accessory buildings are not allowed in the <br />business park in the GI district. Storage should be within the principal building. <br />Section 1 Subd. 1.E. of the zoning ordinance states: <br />Uses Not Provided for Within Zoning Districts. Whenever in any zoning district <br />a use is neither specifically permitted nor denied, the use shall be considered <br />prohibited. .... <br />Staff concludes that accessory buildings are not allowed in the General Industrial zoning <br />district. <br />We acknowledge that at first glance, a different conclusion could be reached because the <br />list of permitted uses in the GI zone includes: <br />Accessory uses on the same lot with and customarily incidental to any of the <br />above permitted uses or of the same general character. <br />However, the City has not allowed accessory buildings in the GI district in the past. <br />Therefore, accessory buildings are not customary there. While it may be customary in <br />other cities to have accessory storage buildings in industrial zones, this has not been the <br />case in Lino Lakes. <br />Several years ago, the landowner constructed two accessory storage buildings. He did <br />not get building permits for either of them. When the City approved a building addition <br />to the principal building in 1999, one of the conditions of approval was that two <br />
