The minimum lot depth is 135 feet. All the lots except Lot 8 comply with this <br />standard. Lot 8 has a depth of 127 feet, which requires a variance. <br />Variance Criteria: The ordinance states that in considering requests for variance the <br />City shall make a finding of fact that: <br />1. That the property in question cannot be put to a reasonable use of used <br />under conditions allowed by the official controls. <br />2. That the plight of the landowners is due to physical circumstance unique <br />to his property not created by the landowner. <br />3. That the hardship is not due to economic considerations alone and when a <br />reasonable use for the property exists under the terms of the ordinance. <br />4. That granting the variance requested will not confer on the applicant any <br />special privilege that would be denied by this ordinance to other lands, <br />structures, or buildings in the same district. <br />5. That the proposed actions will be in keeping with the spirit and intent of <br />the ordinance. <br />The Planning Commission may consider that the site is impacted by wetlands and it is <br />located at the intersection of two collector roads thereby limiting design options as a basis <br />for granting the variance. <br />Grading: The applicant has not submitted information about what house styles are <br />being considered. The grading of the site must accommodate the house styles. Lot <br />grading and critical house elevations need to be added to the grading plans. <br />Existing Structures: An existing shed and pole building are located within the new <br />street right -of -way and must be removed. <br />Transportation and Utilities: Utilities exist in both 12th and Holly, and an <br />extension of utilities down the proposed cul -de -sac is proposed. The water main needs to <br />be looped to 12th Street. The utilities plan is subject to City Engineer review and <br />approval. Holly and 12th are both major collector roads. The purpose of major collectors <br />is to channel traffic, and direct access from lots is discouraged. The number of lots <br />fronting on 12th Avenue has been reduced from five lots in the concept plan to one lot in <br />the preliminary plat. The number of lots fronting on Holly Drive has increased from zero <br />to one. The rest of the lots are proposed to front on a new cul -de -sac street. Based on <br />modifications to the plan which reduces the number of accesses staff supports the layout. <br />
