Royal Oaks Realty CUP — Materials Storage <br />III Page 3 of 4 <br />• <br />• <br />Rice Creek Watershed District (RCWD) has reviewed the site and confirmed that the property <br />doesn't have any wetlands and is outside of the floodplain. The stockpile is partially vegetated <br />and will require additional stabilization. RCWD does not require a formal permit for this <br />activity. They will monitor the site for erosion and sediment control. <br />Tree Preservation Plan: <br />The applicant shall provide a tree preservation plan. The tree preservation plan shall be <br />completed in accordance with the City Tree Preservation Policy. A tree preservation plan will <br />not be required if the materials storage pile is moved at least 50 feet from the existing trees. <br />Recommendations: <br />Staff recommends approval of the conditional use permit subject to the following requirements: <br />1. A Stormwater Pollution Prevention Plan (SWPPP) in accordance with <br />Minnesota Pollution Control Agency (MPCA) requirements must be <br />prepared by the applicant. <br />2. Properly fence and barricade entrances to prevent the general public from <br />depositing garbage or refuse. <br />3. The house foundation must be properly removed from the site. <br />4. The existing septic system must be abandoned according to City <br />requirements. <br />5. The site must be cleared of debris and other objects to provide a safe <br />situation for the proposed material hauling operation. <br />6. Must provide a tree preservation plan or move the storage pile at least 50 <br />feet from the existing trees. <br />7. Maximum slope on the pile shall be a 1 to 1 and in such condition as not <br />to be dangerous because of sliding or caving banks. <br />8. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or <br />other like and similar non - decomposable material. Concrete, asphalt, <br />metal, wood, and other debris shall be prohibited. <br />9. Prepare a site plan showing proposed grade elevations for a maximum <br />amount of 7,000 cubic yards of material. The site plan must show a <br />permanent berm location around the stockpiled earth material. <br />10. The maximum height of the stockpile material shall be 35 feet from grade. <br />
