• <br />• <br />• <br />AGENDA ITEM 5.A <br />STAFF ORIGINATOR: Paul Bengtson <br />P &Z MEETING DATE: October 11, 2007 <br />TOPIC: Grandview <br />Final Plat <br />BACKGROUND <br />Royal Oaks Realty received approval of a Preliminary Plat for Grandview from the City Council <br />on August 13, 2007. The applicant is now requesting final plat approval of the eight lot <br />residential subdivision that will be known as Grandview. <br />ANALYSIS <br />The final plat is substantially conforming to the preliminary plat that was approved by the City <br />Council. Title commitments have been forwarded to the city attorney for review and his <br />comments will be incorporated prior to City Council action on the item. <br />The Development Agreement between the city and developer will address the vast majority of <br />the conditions required by Resolution No. 07 -111 which approved the Preliminary Plat. The <br />exceptions being the conditions requiring the vacation of existing roadway easements and the <br />conservation easement will need to be handled separately. <br />The Vacation of the permanent roadway easement was heard by the City Council on October 8, <br />2007 and the 2nd reading of that ordinance will accompany this final plat and the development <br />agreement to the October 22, 2007 City Council meeting. <br />The Conservation Easement documents have been submitted and mostly mirror the easement <br />granted to the city for Marshan Meadows with a few minor exceptions. The main change is <br />being proposed to address the allowance of docks onto Marshan Lake. The developer's current <br />proposal does not quite meet staffs expectations so we are recommending that it be amended <br />slightly to clarify that docks will be allowed, but all other disturbance of the easement area will <br />be prohibited. This change will be required prior to the City Council review of the Final Plat <br />and an executable copy of the document will need to be submitted prior to the final plat mylars <br />being released to the developer. <br />RECOMMENDATION <br />Staff is recommending approval of the final plat request. <br />This review is based on the following plans and information: <br />Grandview Conservation Easement Documents received September 17, 2007 <br />Grandview Final Plat received October 4, 2007 <br />
