• <br />• <br />• <br />degraded wetland, restoring or conserving adjacent upland buffer or habitat, <br />disconnecting impervious surfaces from direct discharge to stormwater <br />conveyances, or soil amendment /tilling. <br />Analogous to wetland "banking" permitted under WCA, volume control from <br />reestablishing drained wetland, restoring degraded wetland or restoring <br />adjacent upland beyond volume control needed to meet the 2.8 -inch standard <br />may be "banked." Banked volume control credits may be used to meet Rule <br />RMP -3 requirements on a later project within the RMP area by the property <br />owner or, pursuant to private credit sale or transfer, another property owner. <br />Public road projects would not be evaluated under the stormwater quality and <br />volume control requirements of Rule RMP -3. Instead, they would continue to be <br />evaluated under Rule C. Rule C, as recently revised and readopted, incorporates <br />a stormwater quality and volume control framework specifically suited to the <br />conditions of public roadway work. <br />Soil amendment, excavation and filling during development must avoid <br />impeding groundwater flow. Once development is completed, plowed snow <br />must be stored so that it does not drain to wetlands without pretreatment. This <br />commitment would be memorialized in a declaration recorded on the developed <br />property. <br />Easement. The RCWD intends, in conjunction with interested public and private <br />parties, to evaluate and potentially undertake activities to improve and maintain <br />the hydrology and vegetation within the WPC and its associated upland buffer <br />and habitat area. The RCWD, as drainage authority, will continue to maintain <br />the hydraulic efficiency of public drainage systems within the RMP area to <br />preserve their function for the benefit of property owners. Consistent with that, <br />it also reserves the authority to take actions to protect against flooding and <br />enhance the area's wetland ecology. <br />Accordingly, the proposed rule provides for each property owner to convey to <br />the RCWD an easement over wetland within the WPC and associated upland <br />designated as buffer or habitat area.
