APPLICABILITY. <br />(a) A Rule RMP -3 permit is required to: <br />(i) Impact a wetland within the RMP area; <br />(ii) Create more than 10,000 square feet of impervious surface <br />within the RMP area; or <br />(iii) Use motorized equipment to alter land contours within the <br />RMP area so as to increase or decrease the rate or volume of <br />surface runoff into a wetland within the RMP area. <br />(b) For activity subject to this Rule, a separate permit under District Rule B <br />(Procedural Requirements), C (Stormwater Management or F (Wetland <br />Alteration) is not required. Other District Rules including Rule I (Drainage <br />Systems) and the permit requirements of other units of government, <br />including the U.S. Army Corps of Engineers, continue to apply. <br />(c) Sections 5 and 6 below are not applicable, and submittal requirements <br />will be modified accordingly, in an instance where the District is not the <br />local government unit under Minnesota Statutes §103G.005, subdivision <br />10e, responsible for implementing the Wetland Conservation Act. <br />(d) Public linear roadway projects not part of an industrial, commercial, <br />institutional or residential development are partly excepted from this Rule <br />as follows: <br />(i) Wetland impacts are subject to District Rule F rather than <br />sections 4 through 7 of this Rule for the following classifications <br />per MnDOT State Aid Manual Chapter Zero - General Information: <br />Rural Principal Arterials, Rural Minor Arterials, Rural Major <br />RCWD Proposed Rule RMP -3 7 <br />October 8, 2008 <br />
