(c) Easements are required for all outlet swales and ditches, and for overland <br />overflow routes located downstream of basins located on site. <br />(d) If the storm sewer is to be installed less than 10 feet deep within private property, <br />the easement shall be a minimum of 20 feet wide. If the storm sewer is 10 feet or greater, the <br />easement shall be twice as wide as the depth. <br />• <br />(e) Easements necessary for maintenance vehicle access are required for all of the <br />above where not directly available on a public road. <br />(10) Exceptions. <br />(a) Rate control criteria of section 1011.09 (7) may be waived if the site discharges <br />directly to a water body with large storage capacity (such as a public water) that has a time -to- <br />peak elevation greater than that for an on -site pond and the volume discharged from the on -site <br />pond is negligible, relative to the volume of runoff entering the water body. <br />1011.10 INSPECTIONS AND MAINTENANCE <br />(1) Inspections. The applicant is responsible for inspections and record keeping in <br />accordance with the NPDES Permit requirements. The City shall conduct inspections on a <br />regular basis to ensure that both stormwater and erosion and sediment control measures are <br />properly installed and maintained prior to construction, during construction, and at the <br />completion of the project. In all cases the inspectors will attempt to work with the applicant or <br />developer to maintain proper stormwater management. Mandatory inspections, conducted by the <br />city, are required as follows: <br />(a) Before any land disturbing activity begins; <br />(b) Five (5) working days after footing inspections; <br />(c) At the completion of the project; and <br />(d) Prior to the release of financial securities. <br />(2) Post - Construction Inspection and Maintenance of Stormwater Facilities. <br />(a) Private Stormwater Facilities. No private stormwater facility may be approved <br />unless a maintenance agreement is provided that defines who will conduct maintenance, the type <br />of maintenance, and the maintenance intervals. All private stormwater facilities shall be <br />inspected by the owner and maintained in proper condition consistent with the performance <br />standards for which they were originally designed. <br />1. Facility Access. Access to all stormwater facilities must be inspected annually <br />and maintained as necessary. It shall be the responsibility of the applicant to obtain any <br />19 <br />
