No.02 -03 <br />Vacation of Park Land, <br />Pheasant Hills Preserve 9th Addition, <br />ACTION REQUIRED: 3/5 vote <br />BACKGROUND <br />Public Services Director Rick DeGardner is asking for the Vacation of park land. The <br />park land, used for access into the Rice Creek Chain of Lakes, was originally shown on <br />the Final Plat of Pheasant Hills Preserve 9th Addition as located to the east of Lot 5, <br />Block 1. However, the park land was actually constructed by the developer in a different <br />location than that indicated on the Final Plat, and now exists to the west of Lot 5, <br />Block 1. <br />This report is based on the following exhibits: <br />1.) General Location Map <br />2.) Plat Map: Original & New Park Land (access trail) Location <br />3.) Memo from City attorney Bill Hawkins, dated April 13, 2001 <br />ANALYSIS <br />As a result of the above situation, the City has acquired easements for park land (access <br />trail) purposes from the owners of the properties on which the park land is now sited, and <br />Item 7A 1 <br />
