• <br />• <br />• <br />STAFF ORIGINATOR: <br />CITY COUNCIL <br />MEETING DATE: <br />TOPIC: <br />AGENDA ITEM 7C <br />Michael Grochala <br />March 10, 2003 <br />Consider Second Reading Ordinance No. <br />05 -03 Rezoning from R -X, Rural Executive <br />to R -X, Rural Executive /Planned <br />Development Overlay (PDO) <br />VOTE REQUIRED: Simple Majority <br />REQUEST <br />The applicant, James Keefe, is requesting a rezoning of his property to Planned <br />Development Overlay District to allow for a rural cluster subdivision consisting of <br />three buildable lots. Each of the Tots would be accessed from a proposed private <br />roadway lying within a proposed outlot. <br />BACKGROUND <br />In June of 2001 Mr. Keefe contacted City staff requesting information regarding <br />the potential subdivision of his property. Mr. Keefe was provided with the <br />requirements of the R -X, Rural Executive District. In September of 2001 Mr. <br />Keefe met with the City Council to discuss the potential options for subdividing <br />his property. He expressed at the time, in a letter dated September 19, 2001, <br />that he would like to split off several 2.5 acre parcels from his property due to the <br />economic hardship he was currently experiencing. The council expressed the <br />need for additional information before a decision could be made. <br />City staff prepared a memo to the City Council, dated September 28, 2001, <br />identifying issues with regard to the proposed subdivision and listing options to <br />be explored, including the potential for a clustered development using the <br />Planned Development Overlay District (PDO) requirements. The memo was <br />distributed to Mr. Keefe. <br />On December 10, 2002 the City received an application from Mr. Keefe <br />requesting minor subdivision approval. In a letter, dated December 18, 2002, Mr. <br />Keefe was informed that his application was substantially incomplete and listed <br />information that was necessary to begin review of the request. Mr. Keefe <br />submitted additional information on January 6, 2003. <br />
