MEETING DATE: November 10, 2003 <br />TOPIC: PUBLIC HEARING: First Reading, Ordinance No. 22 -03 <br />Vacating Existing Easement <br />Ravens Hollow <br />VOTE REQUIRED: 4/5 <br />BACKGROUND <br />The City Council approved the Ravens Hollow preliminary plat with Resolution 03 -134 on <br />August 25, 2003. There is an easement existing within the area of the plat that should be vacated <br />for the project to proceed as approved by the City. The easement to be vacated is an ingress and <br />egress easement in the north central area of the plat. This was created at the time of the Fox <br />Trace development to provide access to Linda Lane for the lot in the central part of what is now <br />the Ravens Hollow site. <br />There used to be a 66' road easement along the northern edge of the plat, which aligned with <br />62nd St. The northern 33' was vacated for the Fox Trace development. When that occurred, the <br />central lot south of the easement was landlocked because the remaining 33' is not wide enough <br />to accommodate a road. The ingress and egress easement was created to provide access. Since <br />the property is being developed as part of the Ravens Hollow plat, the easement is no longer <br />needed. <br />A different 33' easement that remains along the northern border of the site should be platted as <br />park on the final plat and dedicated to the City. Since a City trail is already located there, it is <br />logical to make the easement into park land. Since the City then will own the land, there will be <br />no reason to vacate the City easement. <br />However, to ensure that the final plat does dedicate that northern 33', staff is recommending a <br />condition of approval: <br />1. Ordinance 22 -03 vacating the easement should not be recorded at Anoka County until <br />the final plat is approved with the park dedication. <br />OPTIONS. <br />1. Approve the first reading of Ordinance No. 22 -03, vacating the easements, with the condition <br />of approval. <br />2. Return to staff with direction. <br />RECOMMENDATION <br />Option 1 <br />
