Planning & Zoning Board <br />April 12, 2000 <br />Page 4 <br />Staff advised that the applicant, Lyndal Nelson, has submitted an application for a <br />variance to allow a 422 square foot addition to his existing attached garage. The <br />Ordinance requires a minimum setback of 30 feet from a local street. The south/east <br />corner of the garage would be 26.5 feet from the property line. The north/east corner of <br />the garage would be 32 feet from the property line. Therefore, the setback encroachment <br />applies only to the south/east corner of the garage. Although Mr. Nelson has a very large <br />lot, 1.6 acres, there is a low area behind the home and a large mound septic system. The <br />applicant prefers to construct a three -car attached garage because a detached garage <br />would need to be quite some distance from the house and would require the removal of an <br />existing storage building on the property to meet ordinance requirements. Staff noted the <br />criteria required for variance consideration and recommended findings of fact. In <br />reviewing the variance criteria, Staff noted that a large Maple tree exists directly behind <br />the north/east corner of the proposed addition creating a physical circumstance unique to <br />the property. Ms. Wyland stated the garage can be moved back by only four <br />feet. <br />Mr. Johnson made a MOTION to approve a 3.5 foot variance to Lyndal Nelson, 87 Lilac <br />Street, to allow a 442 square foot addition to the existing attached garage to be located <br />closer than the required 30 feet from a local street based on the rational that the findings <br />of fact for variance consideration have been met and subject to the following conditions: <br />• <br />• <br />• <br />
