• PLANNING AND ZONING MARCH 11, 1992 <br />t <br />• <br />John Bergeson made the motion to recommend to the City Council <br />approval of variances in Block 1 /Lots 2 -6, 8 -10, 16 -19, 20; Block <br />2 /Lots 2, 3, 6 -8; and Block 3 /Lots 2 -6 of the Shores of Marshan <br />Lake. Robert King seconded the motion and the motion carries <br />unanimously. <br />Al Robinson asked why Block 2 /Lot 5 was not listed for a variance <br />and considering square footage Block 1 /Lot 20 would not need a <br />variance either. Robert Kirmis explained how the measurements were <br />taken and made to determine the need for a variance. <br />ITEM 6. WALBERG /MACIOCH MINOR SUBDIVISION AND VARIANCE P & Z 92 -01 <br />Mr. Walberg and Ms. Macioch have submitted a request to subdivide <br />a 45,000 square foot parcel (Block 1 /Lot 6) of land in Ulmer's Rice <br />Lake Addition into three separate lots. Two of these lots would <br />receive municipal sewer and water, the third would rely on a <br />private system. The variance is needed because two of the new lots <br />would have widths of only 75 feet. <br />Robert Kirmis reviewed the NAC report drawing special attention to <br />the seven conditions: new lots be hooked to utilities at the <br />expense of the developer, if the westerly lot can sustain private <br />sewage and if there should be septic failure it should be hooked up <br />to utilities, that utility and drainage easements be provided along <br />property lines, park dedication, grading and drainage plans and any <br />items to be considered that will be brought by the Engineer. Mr. <br />Kirmis questioned if the newly created lot to the west, at 24,000 <br />square feet, was large enough to accommodate private sewage. <br />John Bergeson asked if park dedication was required. Fred Chase <br />said it has been required. <br />Darrell Schneider reviewed his comments on the Engineers report. <br />Mr. Schneiders concern was 1) the remnent parcel should have a 10 <br />foot wide drainage and utility easement provided along the easterly <br />property line and a 5 foot wide drainage and utility easement <br />provided along the north and south property lines 2) that there <br />needs to be a commitment from the unsewered lots to hook up to <br />utilities and 3) a drainage plan should be included. <br />John Bergeson asked if the owner of the lot was aware of this <br />agreement, Darrell Schneider said he has had no contact with the <br />applicant. Monika Slatten asked if the owner was aware of his <br />responsibility as indicated in the reports. Darrell Schneider said <br />he has not seen the applicant since application was made, but each <br />applicant is sent the reports in the mail. <br />4 <br />
