• <br />PLANNING AND ZONING MEETING <br />May 10, 1989 <br />Mr. Prokop stated the city has on record City Attorney, Bill <br />Hawkin's recommendation stating we could not tear the <br />building down, and stating that a pole barn at this site was <br />feasible. <br />Harold Bisel stated that in this situation we have one unit <br />of government overiding another. Anoka County blatantly <br />violated the cities ordinances. <br />Mr. Irwin feels this situation will not happen again. He <br />also stated that our pole barn ordinance did not apply to the <br />park property. The park property was not zoned, that is why <br />we cannot enforce this. Last Month the Planning and Zoning <br />Board rezoned this area so it would never happen again. <br />Mr. Bisel asked if zoning was not required for this land, <br />then why is the city even doing this much to rectify this. <br />Irwin stated that the true violation was the fact that a <br />building permit was not issued. <br />Pete Kluegel, Building Official, stated that pole barns in a <br />rural district with five acres or more is allowed. And, with <br />0 land 20 acres or more you are allowed unlimited size. <br />But...regardless of the structure a building permit was <br />required and it was ignored. <br />MOTION: Mr. Chase moved to table this issue, and move it <br />back on the agenda while the board reviews the ordinances. <br />Mr. King 2nd the motion, and the motion was approved <br />unanimously. <br />REQUEST FROM EL REHBEIN AND SON TO REZONE LAND ON LAKE DRIVE. <br />APPLICATION #89 -36. (FROM TABLE OF APRIL 12TH). <br />This item was placed on the April agenda, but was tabled at <br />the request of the applicant. <br />John Miller visited with Jeff Joyer on May 3rd, and he <br />indicated to Miller that he and Rehbein marketing the land <br />and looking for an unobtrusive retail user. <br />MOTION: Al Robinson moved to table Application #88 -36 <br />until the applicant is able to come before the board when <br />they have a user compatible with the neighborhood. Mr. Irwin <br />2nd the motion, and the motion was approved unanimously. <br />PRELIMINARY PLAT REVIEW AND CONSIDERATION OF VARIANCE FOR <br />410 PARKVIEW ESTATES, KEITH EIBENSTEINER, APPLICATION #89 -11, AND <br />#89 -20. <br />Keith Eibensteiner purchased two tracts of land located <br />immediately east of Sunrise Park.
