• <br />Page Three <br />PLANNING & ZONING BOARD <br />September 10, 1986 <br />instances, so why would a car wash require such information? <br />MOTION: Mr. Cody moved to recommend to Council that the City Code, <br />Appendix B, Zoning Ordinance be amended by adding a car wash facility <br />(automated, self - service, or full - service) as a conditional use in <br />the general business district. The basis for such motion is that the <br />current zoning ordinance under subdivision 15 dealing with the general <br />business districts lists as conditional uses automobile service sta- <br />tions, motor fuel stations, bus and transit services, automobile and <br />truck repair and the like. It would appear that an automated, self - <br />service or full- service car wash facility would be within the intent <br />of the conditional use section of the general business section as <br />now contained in our ordinance. It would certainly appear to be <br />arbitrary and capricious if we were to fail to amend our ordinance <br />to include a car wash facility when we have other uses that are so <br />much in a similar state. Mr. McLean seconded the motion which carried <br />unanimously. <br />Mr. Schumacher explained to the Board that the Council sent this <br />issue back to the P & Z Board for further information. The Board <br />has stated why they do not wish to concern themselves with tax base <br />and traffic counts, but if the question of environmental impact is <br />not answered, he felt that the Council would simply send the text <br />amendment back to the P & Z and not approve the ordinance allowing <br />car washes. Mr. Schumacher stated that his understanding of the <br />Council's concern was that the general business zones would include <br />unsewered areas. <br />Mr. Kluegel recommended that the Extension Agricultural Engineer <br />from the University of Minnesota (Mr. Roger Machmeier) be contacted <br />for an expert opinion regarding the environmental impact question. <br />Mr. Otte was in attendance along with an engineer who explained the <br />type of waste control system and drainfield system which Mr. Otte <br />would be using. Mr. Otte explained that the City of St. Cloud pres- <br />ently has a system similar to that which Mr. Otte will propose. <br />The City requires that the owner pay for periodic monitoring. <br />Mrs. Klaus suggested that the conditional use portion of the text <br />amendment specify that the owner pay for regular pollution monitor- <br />ing of a waste control system in an unsewered area. <br />The Board asked that Mr. Kluegel pass on the expert opinion he receives <br />from the University engineer for the Council's consideration at their <br />next meeting. <br />At this time the Board took a 10- minute break. <br />TEXT AMENDMENT - GLARE <br />Mr. Kluegel reported that the City Attorney, Mr. Hawkins suggested <br />that if the City wishes to have a "glare" ordinance, it be included <br />within the nuisance ordinance portion of the City Code. Several <br />other cities' ordinances were compiled and presented to the Board. <br />
