• • • CITY COUNCIL WORK SESSION JANUARY 5, 2000 Mayor Bergeson advised the City would have a short Council for the next three- (3) months. The City Attorney has been asked to prepare a report regarding voting requirements within a short Council. Staff advised a report from the City Attorney would be given at the regular Council meeting Monday, January 10, 2000, 6:30 p.m. Examples of voting requirements will be included. OAK BROOK PENINSULA EASEMENT VACATION, JOHN POWELL Staff advised the specific action requested by Russell and Elizabeth Melton, the owners of Lot 2, Block 1, Oak Brook Peninsula, is the vacation of a portion of the City's drainage and utility easement which contains a hockey rink which the Melton's have constructed. The specific area requested includes not only the hockey rink but also the area parallel to, and within 12 feet of the rink. Staff explained there have been many other issues raised with reg. Staff advised the swale must be restored to acceptable standards, which is defined as having a bottom and maintainable sides. Ms. Melton asked who would pay for the construction of the swale. She stated the developer did come back and dig a ditch but is now done. Staff advised the City would not pay to construct a swale. Ms. Melton suggested the Schwartz's pay for the swale because it benefits them and it was not in the original plan. She continued stating she appreciates staff recommending the vacation. She stated the developer has proved there is the right amount of compensatory storage. The size of the pond has been increased. She added that she hopes the City will allow the rink to stay in place.
