• <br />• <br />• <br />CITY COUNCIL WORK SESSION JANUARY 5, 2000 <br />Mayor Bergeson advised the City would have a short Council for the next three- (3) <br />months. The City Attorney has been asked to prepare a report regarding voting <br />requirements within a short Council. <br />Staff advised a report from the City Attorney would be given at the regular Council <br />meeting Monday, January 10, 2000, 6:30 p.m. Examples of voting requirements will be <br />included. <br />OAK BROOK PENINSULA EASEMENT VACATION, JOHN POWELL <br />Staff advised the specific action requested by Russell and Elizabeth Melton, the owners <br />of Lot 2, Block 1, Oak Brook Peninsula, is the vacation of a portion of the City's drainage <br />and utility easement which contains a hockey rink which the Melton's have constructed. <br />The specific area requested includes not only the hockey rink but also the area parallel to, <br />and within 12 feet of the rink. <br />Staff explained there have been many other issues raised with reg. "'' hockey rink. <br />The specific request to be considered by the Council at this ti on of a <br />portion of the City's easement. Other issues such as the ring ± g;'� and setbacks, <br />etc., can be considered after the Council makes a decisio ���n�is� urrently <br />presented. Staff advised the swale must be restored to acceptable standards, which is <br />defined as having a bottom and maintainable sides. <br />Ms. Melton asked who would pay for the construction of the swale. She stated the <br />developer did come back and dig a ditch but is now done. Staff advised the City would <br />not pay to construct a swale. <br />Ms. Melton suggested the Schwartz's pay for the swale because it benefits them and it <br />was not in the original plan. She continued stating she appreciates staff recommending <br />the vacation. She stated the developer has proved there is the right amount of <br />compensatory storage. The size of the pond has been increased. She added that she <br />hopes the City will allow the rink to stay in place. <br />
