• <br />• <br />COUNCIL MINUTES OCTOBER 11, 1999 <br />Staff noted that Mr. Vaughan would be present for the second reading of the Ordinance. At that <br />time he will voice his concerns. <br />Council expressed concern regarding approval of the first reading and the possible denial of the <br />second reading after Mr. Vaughan's presentation. The City Attorney advised the second reading <br />is the one that counts. He also said that the matter was discussed in federal court at which time <br />both parties agreed to the settlement. Any dispute by Mr. Vaughan must go back to the District <br />Court since the City has fulfilled the terms of the settlement. He noted that provisions for <br />development of the island are included in the settlement. <br />Mr. Rob Rafferty, 1573 Merganser Court, came forward and asked for clarification of the <br />established pathways on the preliminary plat. He asked if those pathways would still exist. <br />Council determined that a discussion regarding the trails promised to residents would be held at <br />the next Council work session. <br />Council Member Neal moved to approve the FIRST READING of Or o. 21 - 99, as <br />presented. Motion carried unanimously. <br />Resolution No. 99 - 96, Receive Feasibility Report and Set Public Hearing Nancy <br />Drive/Vicky Lane Feasibility Study, John Powell - Earlier this year, the Council ordered the <br />preparation of a feasibility report investigating the improvement of Nancy Drive and Vicky Lane <br />by constructing watemain and sanitary sewer. The report is complete and staff requested Council <br />to receive the report and call a hearing on the improvement. The hearing is scheduled for <br />November 22, 1999, at which time a detailed review of the feasibility report will be presented. <br />In accordance with Minnesota State Statues 429, and the Lino Lakes Charter, the feasibility <br />report is to be received by Council and a public hearing scheduled. <br />Staff noted that because the feasibility study for Vicky Lane and Nancy Drive was combined, it <br />resulted in much higher assessments to the Vicky Lane residents and lower assessments to the <br />9 <br />
