COUNCIL MINUTES OCTOBER 11, 1999 <br />Council noted that the intent of the approval is that access to land beyond this development will <br />not be constricted by the agreement. <br />Motion carried with Council Member Neal abstaining. <br />Council asked staff for an update on the project at the next Council work session. If necessary, <br />this item will be put on the regular Council meeting agenda. <br />SECOND READING, Ordinance No. 18 - 99, Easement Vacation, Behm's Century Farm <br />5th Addition, Mary Kay Wyland - Staff advised Council approved the First Reading of this <br />Ordinance at the September 27, 1999, meeting. <br />Staff recommended adoption of the SECOND READING of Ordinance No. 18 - 99, vacating the <br />roadway and drainage easements as indicated with the understanding that all required roadway <br />and drainage /utility easements will be dedicated with the Behm's Century Farm 5th Addition <br />Final Plat. <br />Council Member Bergeson moved to approve the SECOND R <br />99, as presented. Ma an voted yea. <br />Motion carried unanimously. <br />Ordinance No. 18 - 99 can be e end'of these minutes. <br />Mayor Sullivan calle . w. a s recess at 8:03 p.m. <br />Mayor Sullivan reconv meeting at 8:14 p.m. <br />PUBLIC HEARING, FIRST READING, Ordinance No. 21- 99, Authorizing the <br />Conveyance of Property to Ed Vaughan, Brian Wessel - As part of the land exchange with <br />Anoka county, the City acquired some property from developer Ed Vaughan that was then <br />convened to the County. Mr. Vaughan contested that purchase and during the trial it became <br />clear that the property the city intended to acquire was different from the property the City <br />actually acquired. As part of the settlement with Ed Vaughan that the City agreed to petition the <br />County for reconvene of certain small parcels of property. <br />The Anoka County Park Board and the Anoka County Board of Commissioners have agreed to <br />reconvene some parcels of property to the City. The action tonight authorizes the conveyance of <br />the property the city received from Anoka County directly to Mr. Vaughan. Thus, the terms of <br />the settlement agreement with Mr. Vaughan has been met. <br />8 <br />
