• <br />Planning & Zoning Board <br />July 14, 1999 <br />Page 14 <br />Mr. Dunn stated he is very familiar with the intersection. He stated he would be the first <br />to object if there is site impairment problems. The project will increase the value of the <br />home in the neighborhood. He stated it is an appropriate time to use a variance and he <br />supports the project. <br />Mr. Johnson stated he does not agree. If the Board grants this variance it will be hard <br />pressed to deny others like it. There are no unique circumstances or hardship in this case. <br />He indicated he does not support the project. <br />Ms. Carlson expressed concern regarding setting a precedence if the variance is granted. <br />Mr. Dunn stated the Board needs to look at and value the property. He stated this is the <br />purpose of a variance. There is hardship here and each case should stand on its own <br />merit. <br />Ms. Carlson stated her house is similar to the applicant's so she has an understanding. <br />Variances should be granted on obvious hardship. Granting the variance could present an <br />opportunity for a legal argument with other variance r t °-sts. <br />Mr. James Lambrecht, 1083 Aspen Lane, came f stated there are other homes <br />within the City that are closer to the street tha .'e stated a porch on the north side of <br />his home would not look right. He stated is a ,,: for a small variance that would <br />improve his property value. <br />Mr. Dunn added that on the very <br />asking for. Ms. Wyland advise <br />setback is less than what the applicant is <br />re" °ique characteristics to that property. <br />Mr. Corson stated the proje ° F °: t meet the criteria needed for a variance. A <br />precedence will be set if the v. a e is granted. The setback requirement becomes <br />effective when the deck becomes a structure. <br />Mr. Lambrecht asked if his only option is to change the ordinance. Ms. Wyland advised <br />the request will go before the City Council for a final decision. The Planning and Zoning <br />Board is only an advisory Board. <br />Mr. Dunn made a MOTION to approve variance request, and was supported by Acting <br />Chair Lane. Motion failed 2 -4 with Mr. Schilling, Mr. Johnson, Mr. Corson, and Ms. <br />Carlson voting no. <br />This item will go before the City Council Monday, July 26, 1999, 6:30 p.m. <br />VI. DISCUSSION ITEMS <br />Ms. Carlson stated the Hugo Water Service was discussed at a past Council work session. <br />She stated the issue involves a certain plat.
