Performance Security Required: The applicant shall provide security for the performance of its obligations pursuant to this section following City approval of the Landscape /Screening Plan and prior to commencement of any land disturbing activity as follows: 1. Amount of security: a) Letter of Credit — A letter of credit equal to one - hundred fifty percent (150 %) of the estimated cost of the landscape plants and other elements of the approved Landscape /Screening Plan. The applicant shall submit a schedule of costs associated with implementation of the approved Landscape /Screening Plan, including non -plant elements. In the event of any disagreement, the City will use the current Bachman's Wholesale Catalog (published annually), or equivalent regionally -based wholesale nursery catalog, to estimate the cost of landscape plantings proposed on the approved Landscape/Screcning Plan. For non -plant elements, the City will estimate the costs for comparison purposes. [needs work] b) Cash Escrow — A cash escrow equal to one hundred percent (100 %) of the cost of staff time associated with monitoring and enforcement of the Landscape /Screening Plan as estimated by the City. 2. Release of Security - The applicant shall notify the City when the planting has been completed so the City can verify that the landscaping and/or screening is completed, identify any discrepancies with the approved Landscape/Screening Plan, and confirm the planting completion date. a) The security shall be retained for at least one year after the date the planting is completed. Prior to release of the security, the City shall inspect the site to verify compliance with the approved Landscape /Screening Plan. If non - compliance is found, the City may retain security to cover the cost of bringing the project into compliance. b) In no event shall the performance security be released before expiration of the one -year plant warranty period. 5 TOTAL P.09
