The Spirit Hills Development is located in <br />the E% of Section 30, Township 31 North, Range 22 West, Anoka County. The Spirit Hills Development is <br />also located within the 1000' shorcland district of Rice Lake (2- 0008P) which has a shorcland classification <br />of natural environment. <br />The 1)NR does not object to the approval of the rezoning request that would zone the Spirit l lilts Development <br />as a Planned Development Overlay with the condition that the regulations for a Planned Development which <br />arc found in the City of Lino Lakes Shoreland Management Ordinance arc; met. One of these conditions is <br />found in Section 1102.13, Subdivision 4 which states that wetland areas should not bc included in the <br />developed area of the Planned Development. We are concerned to sic that very large portions of the W CA <br />wetland fringe of Rice Lake (which is above the ordinary high water level) have been platted as parts of lots <br />1 through 15. We request that the preliminary plat bc changed to exclude these wetland areas from being parts <br />of the lots in question. We recommend that the wetland areas be included as part of the open space that is <br />required by Section 1102, Subdivision 4,C, 1 of the City of Lino Lakes Shoreland Ordinance. In fact, the <br />inclusion of these wetlands into the open space is required by Section 11(32.13, Subdivision 4,D,3 of the City <br />Ordinance. In addition, Section 1102.13, Subdivision 4,C.2 requires that the Planned Development Association <br />adopt conservation casements and association covenants that preserves the open space: areas that are designated <br />in the development. These documents are required to bc approved by the City of Lino Lakes. Should the lots <br />in question bc changed to exclude the wetland areas, then we recommend that monuments be placed at the <br />wetland edge along each of the lot lines as a means of informing the lot owners of the location of the beginning <br />of the wetland. <br />We also recommend that the City of Lino Lakes require that the Spirit Hills development adopt documents that <br />will preserve the vegetation, topography and appearance of the open space as required by Section 1102.13 <br />Subdivision 4,F,4. The Spirit Lake Development should be required to preserve existing trees whenever <br />possible, and to plant additional trees when necessary, in order to screen the view ofthe development frtrrn the <br />users and other shorcland owners of Rice Lake.
