We recommend that <br />construction in these steep slope areas follow the requirements listed in Section 1102.07, Subdivision 2, f3,5 <br />in which work on these slopes is minimized and the erosion control plans for the work approved by the City <br />Engineer. <br />In addition to the cummcmts relating to the City of Lino Lakes Shoreland Management Regulations, we have <br />the following comments to offer: <br />1 • We are pleased to sec that DNR Protected Water, Rice Lake (2 -0008 P) and its Ordinary 1 high Water <br />(OHW) level of 883.1' (NGVD, 1929) are shown on the preliminary plat of Spirit Hills Development. <br />Please bc aware that any work below the O1-1W of Ricc Lake (including stormwatcr outfhll <br />installation) is under the jurisdiction of the DNR, and may require a DNR Protected Waters Permit. <br />2. While it is good to see that two sediment basins arc being designed for the Spirit Hills Development, <br />other techniques that reduce thc amount of stormwater that needs to bc treated should bc incorporated <br />into Spirit Hills because sediment ponds remove only a fraction of the pollutants in stormwatcr before <br />it is discharged into Rice Lake. Whenever the curbs, gutters and stormsewers of a street should he <br />replaced with wide, shallow swalcs because swalcs can remove some pollutants and infiltrate some <br />water. Stormsowers simply funnel pollutants to the sediment ponds. Stounwater swages work best <br />when they contain. native vegetation that' is mowed only once a year. <br />in addition, Lino Lakes should consider the use of other low impact development techniques for dealing <br />with stormwatt= including using rain gardens, dry wells, permeable pavements, infiltration trenches, <br />and other similar techniques. The grading of the Spirit Hills site: should be minimized in order to avoid <br />compacting the soils. In landscaped ercas where grading has occurred, a ripper should be used to <br />loosen the soils and partially restore the infiltration capabilities of the site. <br />3. Rice Lake has a 1% (104 year) flood elevation of 8A6.0' (NGVD, 1929). In addition, the wetlands and <br />sediment ponds of SpiritHills development will also have 1% flood levels of their own. We encourage <br />the City of Lino Lakes and the Rice Creek Watershed District to take steps to ensure that the structures <br />that are constructed in Spirit Hills development will not be flooded by any nearby body of water. <br />4. If construction involves dewatering in excess of 10,000 gallons per day, or 1 million gallons per year, <br />a DNR appropriations permit is needed. Applications for less than 50 million gallons may be <br />approval under a general permit for dewatering and typically takes five (5) days to process. <br />5. if construction activities disturb five acres of land, or more, the contractor must apply for a stortnwater <br />permit from the Minnesota Pollution Control Agatcy (Keith Cherryhohnees at 651- 296 - 7036). <br />6. The comments in this letter-address DNR Waters jurisdictional matters and concerns. These comments <br />should not be construed as DNR support or lack thereof for a particular project. <br />I apologize: for thc untimeliness of these comments and thank you for submitting the preliminary plat and <br />rezoning request of Spirit Mils Development to the DNR for review. We request that you send copies of the <br />Spirit Hills development decision to Tom Hovey at the above address. We look forward to receiving other <br />#3/4 <br />
