Large to medium sized deciduous trees shall be a minimum of two and one -half (2'/s) <br />caliper inches at time of planting. <br />4. Small deciduous trees shall be a minimum of one and one -half (1 'h) caliper inches at <br />time of planting. <br />5. Evergreen trees shall be a minimum of six (6) feet in height at time of planting. <br />6. Replacement trees shall be healthy stock, free of insects and disease, and meet the <br />guidelines set by the American Standards of Nursery Stock and/or Inspection and <br />Contract Administration Guidelines for MnDOT Landscape Projects. The City can <br />reject trees if found to not meet these standards. <br />7. The following shall not be used as replacement trees: <br />• Siberian Elm <br />• Norway Maple <br />• Amur Maple (A. ginnala) <br />• Cottonwood or Silver Maple (unless specifically approved by City) <br />V. COMPLIANCE AND ENFORCEMENT <br />A. Compliance with approved plan: <br />1. Protection Measures: The applicant shall implement the tree protection measures <br />indicated on the approved Tree Preservation Plan prior to commencement of any land <br />disturbance activity on the property. The tree protection measures shall remain in <br />place until all grading and construction activity is terminated, or until a request is <br />made to and approved by the City Forester. <br />2. Plan Implementation: Replacement trees shall be planted within six (6) months after <br />completion of site construction activities, unless otherwise approved by the City. <br />Failure to implement the plan within this time frame shall constitute non- compliance, <br />subject to the actions outlined in Section V.B. <br />3. Unauthorized Removal: If a significant tree(s) or woodland that was intended to be <br />preserved in accordance with the approved Tree Preservation Plan is removed without <br />permission of the City or sustains critical damage, the applicant shall replace each <br />tree so removed or destroyed at a rate of three (3) caliper inches (replacement tree) <br />for each caliper inch (significant tree) removed. Replacement trees shall be of the <br />same, or similar species as the lost tree. The size and quality of replacement trees <br />shall meet the requirements of Section N.D. <br />9 <br />
