CITY OF <br />1 0/24/94 <br />Administration <br />City Permits <br />• <br />Background <br />Surface Water Management <br />As stated in State Statutes 103D.335, Subdivision 23 and 103B.211, <br />Subdivision 1, the City can assume the role of permittee for all <br />land alteration, thereby enforcing the policies and standards of this <br />plan. - RCWD and VLAWMO will continue review and comment <br />on . any proposed land alteration. The WMOs can appeal City <br />approval of a particular project if the project is considered to be <br />inconsistent with the City's local water management plan. <br />The Local Plan is intended to address all areas currently being <br />permitted by RCWD and VLAWMO. However, in some cases, an <br />activity may not be directly addressed in the Local Plan. In these <br />instances the RCWD or VLAWMO plans will be used to determine <br />if an activity needs to be permitted. A list of unique permitted <br />activities will be listed in the Reference Document in the appendix <br />as part of the RCWD or VLAWMO data. <br />Wetland Conservation Act <br />The Wetland Conservation Act of 1991 requires a local government <br />unit (LGU) to be identified to administer the interim provisions of <br />the act. The Board of Water and. Soil Resources has suggested that <br />the responsibility be given to the LGU that will be ultimately <br />responsible for administering -the permanent program beginning <br />January 1, 1994. Within the seven- county Metropolitan area, only <br />cities, townships and water management organizations (WMOs) <br />can administer the permanent wetland regulation program. <br />The administration of the regulations will be performed by the <br />same entity that is regulating the water management activities of <br />the 103B.231 directive. Those local governments that have <br />prepared and adopted a local water management plan should then <br />be the LGU for the area under its jurisdiction. Local governments <br />that have not adopted a local water management plan should be <br />under the jurisdiction of the WMO; that is, the WMO should be <br />the LGU. <br />Local Water Management Plan SEH NO: LINOL9402.00 <br />Policy Document <br />Page 26 <br />
