(Above space is Reserved for Recording Information) <br />DECLARATION OF RESTRICTIONS AND COVENANTS <br />FOR <br />A DRAINAGE AND UTILITY EASEMENT <br />This Declaration of Restrictions and Covenants for The Drainage and Utility Easement <br />(Declaration) is made this day of 2004 by the undersigned Declarant: <br />RECITALS <br />A. The Declarant holds the fee title or perpetual easement on the real property <br />described as follows: <br />See Attached Exhibit "A "; <br />RESTRICTIONS AND COVENANTS <br />The Declarant makes the following declaration of restrictions and covenants for the <br />Drainage and Utility Easement. These restrictions and covenants shall run with the land, and bind <br />Declarant, and Declarant's heirs, successors, and assigns: <br />1. The Declarant shall maintain a Drainage and Utility Easement of the size and type <br />specified in Exhibit A. Declarant shall not make any use of the Drainage and Utility Easement <br />that would adversely affect the functions or values. <br />2. Declarant grants to the City of Lino Lakes, the local Watershed and their agents, <br />reasonable access to the Drainage and Utility Easement for inspection, monitoring, and <br />enforcement purposes. This Declaration grants no access to or entry on the lands described to the <br />general public. <br />Page 1 of 3 <br />
