• <br />• <br />Mr. Smyser <br />Oct. 1, 03 <br />Pg. 2 <br />Item 14 — Water - related Land Use Management District <br />The majority of Wards Lake is within the Regional Park Reserve, resulting in a regional interest to protect <br />the water resource. The EAW indicates the minimum lot size will be 20,000 square feet, the minimum lot <br />width 80 feet, and the structure setback 150 feet. These requirements are significantly less that the statewide <br />Minnesota Department of Natural Resource minimum standards for a Natural Environment classified lake. <br />The statewide minimum standards for a non - sewered natural environment lake are: <br />200 feet lot width, <br />80,000 sq. feet minimum lot size, and <br />150 /150 sewer /structure setback. <br />The statewide minimum standards for sewered natural environment lake are: <br />(Assuming that sewer was feasible and approved by the City) <br />- 125 feet lot width, <br />40,000 sq. feet minimum lot size, and <br />150 structure setback. <br />Council staff suggests that the City give further review to the standards being applied to this site in <br />relationship to the recommended state standards. Without the planned unit development designation, the <br />proposed project would be subject to the City's shoreland ordinance. <br />Item 16 — Erosion and Sedimentation <br />The EAW identifies (hay) bale, checks (Figure 12) as one of the methods proposed to be specified for use as a <br />temporary erosion control measure during construction grading on the proposed project. The Minnesota <br />Pollution Control Agency (MPCA) currently considers hay bales to be generally ineffective in controlling <br />erosion and sedimentation and no longer recommends using hay bales. Other options may be, checked dams <br />of rock, staked heavy duty silt fences with large pore sizes, temporary retention ponds, and/or heavy <br />temporary mulching on side slopes (followed by immediate re- vegetation) in lieu of hay bales. Council staff <br />recommends altering the specifications for this (and other similar) proposed project(s) to conform to these <br />revised MPCA erosion control recommendations. <br />This concludes the Council's review of the EAW.
