That the developer give <br />consideration to imposing deed restrictions in 10 foot buffer areas around all <br />wetlands. That developer give consideration to sharing these deed restrictions <br />with the city. <br />Response: The developer will change the following language and incorporate into the <br />covenants: <br />Article II - Easements <br />2.4 Drainage Easements around ponds and wetlands. <br />Purchaser acknowledges that no dredged or fill material may placed into waters, <br />wetlands or drainage easements and no cutting, removing or burning of vegetation <br />will be allowed within drainage easements around ponds and wetlands without the <br />written approval from the City authority and from the the Corps of Engineers, <br />Minnesota Department of Natural Resources, and the Watershed District, where <br />applicable. <br />The developer will include the additional 10 ft. buffer area into the easement. The developer <br />would ask the City of Lino Lakes to incorporate covenants into the zoning approval and would be <br />named as the successor to the developer in the recorded document. This should satisfy the sharing <br />of deed restrictions and Commissioner Johnsons concern as to how these covenants can be <br />enforced after the developers homes are complete. <br />
