• <br />Regarding the Planning Commission's suggestion that these ponds and wetlands be open for use <br />by all residents of Lino Lakes, I am opposed for the following reasons: <br />1. <br />The Rice Creek Watershed requires me to sign a personal guarantee to maintain <br />the integrity of the vegetated buffered areas. This agreement is perpetual and <br />would become impossible for me to enforce if these areas become recreational <br />and open to the public. <br />2. I have designed these upgraded wetlands for aesthetic reasons and to create large <br />buffers between developments. Opening these areas up for public use would <br />destroy the buffered areas and the privacy of the new home owners. <br />3. I have platted through these areas so individual home owners are responsible <br />for the liability insurance. This would have to change if open to public use, as <br />individual owners can not be expected to be liable for what would be public <br />land or park. <br />I have dedicated approximately twelve acres of upland and wetland to the city for park dedication <br />adjacent to West Shadow Ponds. If the city council agrees, I am recommending that the ponding <br />for public use take place on the park land. The second alternative is to build skating rinks on the <br />upland under park supervision. <br />Prior to the council meeting, as per the City Planning and Zoning Commission, I would ask that <br />the Ci Attorney review my suggestion for sharing the deed restrictions through enforcement of <br />e covenants his opinion on the use of wetlands and ponds on private property. <br />Thank you, <br />RSC:lh <br />Car on <br />
