COUNCIL MINUTES NOVEMBER 23, 1998 <br />Mayor Sullivan recessed the meeting for five (5) minutes at 8:17 p.m. <br />Mayor Sullivan reconvened the meeting at 8:30 p.m. <br />Zoning Text Amendment Pertaining to Non - Conforming Structures, Mary Kay Wyland <br />(415th Vote) - Ms. Wyland stated the Planning and Zoning Board suggested the following text <br />amendment as a result of the recent variance request from a property owner on Bald Eagle <br />Boulevard. This amendment would allow additions to non - conforming structures provided there <br />is no increase in the number of units or an expansion in the degree of non - conformity. The <br />Zoning Ordinance, Section 3, Subd. 2 B.9 currently reads as follows: <br />Alterations may be made to a structure containing non - conforming residential units when <br />they will improve the livability thereof, provided they will not increase the number of <br />dwelling units or expand size of existing building or structure. <br />The proposed language is as follows: <br />Alterations may be made to a structure containing non - conforming residential units when <br />they will improve the livability thereof, provided they will not increase the number of <br />units or expand the size or degree of non - conformity. <br />Council Member Neal asked if this was the farm next to Andy Cardinal. Ms. Wyland stated the <br />property that precipitated the change is on Bald Eagle Boulevard. <br />Council Member Bergeson stated the Council in the past has done with a variance what this <br />amendment suggests. The justification for prior variances is it did not increase the size of the <br />non - conformity. This change puts it into the code. <br />Council Member Neal asked how the Planning and Zoning Board voted. Ms. Wyland stated the <br />Planning and Zoning Board vote was 7 -0 in favor of the amendment. <br />Council Member Lyden moved to approve the First Reading of the Ordinance Amendment, as <br />presented. Council Member Neal seconded the motion. Motion carried unanimously. <br />Comprehensive Land Use Plan, Brian Wessel - Mr. Wessel stated that communities within the <br />seven (7) county metro area have been mandated, by State Legislation, to submit their updated <br />comprehensive plan to the Metropolitan Council by year end. The Comprehensive Plan Task <br />Force approved the Lino Lakes Comprehensive Plan on a 12 -0 vote, the Lino Lakes Planning and <br />Zoning Board approved the plan on a 6 -1 vote. Staff would recommend submittal to the <br />Metropolitan Council of the Draft Comprehensive Land Use Plan for the City of Lino Lakes. <br />This plan will then be reviewed by Met Council staff. That staff review may include <br />recommendation for approval or suggest changes or revisions to the plan. Upon completion of <br />the Met Council review, the City Council will be asked to adopt a final draft of the Plan. This <br />will most likely occur in the first quarter of 1999. <br />14 <br />
