INTERCONNECT AGREEMENT CONTRACT FOR JOINT USAGE OF WATER FACILITIES BY AND BETWEEN THE CITY OF LINO LAKES AND THE CITY OF CENTERVILLE, ANOKA COUNTY, MINNESOTA THIS AGREEMENT, made and entered into this day of , 1999, by and between the City of Lino Lakes, a municipal corporation, situated in Anoka County, Minnesota, hereinafter called "Lino Lakes ", and the City of Centerville, a municipal corporation, situated in Anoka County, Minnesota, hereinafter called "Centerville ". Both Lino Lakes and Centerville have the authority to enter into this agreement pursuant to Minnesota Statute 471.59. WHEREAS, Lino Lakes has constructed a water system capable of providing emergency and peak demand water supply service to Centerville, and Centerville is considering water system improvements including the construction of an elevated water storage tank and trunk watermains. WHEREAS, until this water system in Centerville is fully developed with source, distribution, and storage capacity, this area can be more effectively served by interconnection with Lino Lakes water system. WHEREAS, after the completion of the Centerville water system a more reliable water supply in both Lino Lakes and Centerville would result from the interconnection between the two communities water systems. NOW, THEREFORE, the parties hereto agree as follows: SECTION 1. GENERAL CONDITIONS 1. In consideration of the covenants and agreements herein set forth, Centerville shall construct a water system connection to the public water system of Lino Lakes subject to all terms, conditions, and provisions of this Agreement as hereinafter expressed.
