Liquor Ordinance <br />May 19, 1998 <br />page 4 <br />SUMMARY OF CHANGES TO THE LIQUOR ORDINANCE <br />To facilitate discussion for the first reading of the ordinance, here is a summary of the <br />proposed changes included in Ordinance 13 -99. The ordinance itself also is attached. <br />After discussion at the work session tonight, I will insert into the ordinance the chosen <br />option regarding the separation from and definition of schools. A full green sheet and <br />complete ordinance will be sent to you Friday in time for the Monday meeting. <br />701.02 Subd. 9 Reserve two on -sale licenses for restaurants in the Town Center <br />and reserve one license for a restaurant in the I -35E commercial area. The reserved <br />licenses would be only for restaurants seating a minimum of 50 guests at one time and <br />that get at least 50% of gross revenues from non - alcohol sales. (After discussion at the <br />work session and based on comments from the City Attorney, I've raised the seating <br />minimum from 40 to 50 and added a reference to a map that will show the areas for the <br />reserved licenses.) <br />701.03 Clarification that patio, garden, or sidewalk service areas must be <br />described on the license application. Such outdoor areas will require a conditional use <br />permit. <br />701.04 Removes the list of fees from the liquor ordinance and creates a separate <br />fee schedule that can be amended by resolution. <br />701.05 Subd. 1 The investigation fee is increased from $150 to $250 for <br />individuals, and from $300 to $500 for partnerships and corporations. Another change <br />clarifies that investigations of license applicants by the City will be done through the <br />Public Safety Director. <br />701.05 Subd. 1.a. Adds new paragraph stating that the business must allow police, <br />fire, and health inspections of the premises. <br />701.05 Subd. 4 Removes the requirement that a corporate license applicant must <br />have a City resident as a manager. <br />701.06 <br />resident. <br />Removes the requirement that any license applicant must be a City <br />701.07 Subd. 2 Removes the requirement that a new business must be in operation <br />for six months before it can get a liquor license. <br />
