AR'I'ICLL V <br />OTHER RIGH 1'S AND OBLIGATIONS OF (DECLARANT <br />There shall be no obstruction of the common areas except construction material and equipment during the <br />construction period or except as specifically provided herein. Nothing shall be altered on, constructed in,or <br />removed from the common area except upon the prior written consent of Declarant. Nothing contained in <br />this Declaration shall be construed or deemed to constitute a dedication, express or implied, of any part of <br />the common areas to or for any public use or purpose whatsoever. <br />ARTICLE VI <br />ADDITIONAL RESTRICTIONS <br />6.1 Land Use and Building Type No lot shall be used except for residential purposes. No building <br />shall be erected, altered, placed or permitted to remain on any lot other than one single- family <br />dwelling not to exceed two stories in height and one accessory building, attached or detached, <br />to be used as a hanger and shelter for the owner's aircraft, which may be erectd on such portion <br />of the lot as otherwise complies with all of the other terms, conditions and provisions of this <br />Declaration of Covenants, Conditions and Restrictions and with the approval of the Architectural <br />Control Committee, and such other articles as may be incidental to the use of the principal building <br />for residential purposes. <br />6.1 Lot Subdivision No lot in block one shall be subdivided beyond its dimensions as shown on the <br />recorded plat Surfside 1st Additon, as on file and of record in the office of the Anoka County <br />Recorder, in and for Anoka County, Minnesota. <br />6.3 Dwelling Cost, Quality and Size All dwellings shall be of quality of workmanship and materials <br />substantially the same or better than that which can be produced on the date this Declaration is <br />recorded at the minimum permitted dwelling size. The ground floor area of the main structure, <br />exclusive of one story porches, garages, and basement area, shall not be less than 1300 square <br />feet on one -story dwellings, and 1000 square feet on one and one -half and two story dwellings. <br />6.4 Removal of Soil and Trees No dirt, sand, gravel, clay, peat of any kind or nature, shall be reproved <br />from the lots except to some other lot in Surfside 1st Addition, without the express consent of the <br />Declarant. It shall be the duty of every lot owner to have a dirt placement area and a tree burning <br />area designated at time of building by the Architectural Control Commitee. It being the intention of <br />this paragraph to preserve the natural terrain and trees as much as possible and maintain construc- <br />tion areas in a clean and neat fashion as the circumstances will allow. <br />6.5 Location of Building and Other Structures Any building or other structures permitted by these <br />Declarations, shall not be constructed on any lot to a height which exceeds 10 feet in height which <br />exceeds in height for each 70 feet of distance from the center line of the runway. Said distance <br />from center line of said runway is to be measured perpendicular. It is the intention of this provision <br />to conform all structure height to a 7 to 1 glide ratio as used, defined and understood in regulations <br />of the Minnesota Department of Transportation Division of Aeronautics. <br />6.6 Tanks for Fuel Storage No tanks of any kind shall be erected, placed or permitted upon any lot. <br />6.7 Aircraft No other aircraft other than the aircraft which is the property of the owner, or the owner's <br />lessees, contract vendee, or life tenant, and temporary guests of said owners, shall be parked on a <br />lot. <br />6.8 Signs No signs, except a temporary Garage Sale sign or For -Sale sign may be displayed provided <br />that it is in such form as Declarant may require except that Declarant shall be permitted to erect and <br />
