AGENDA ITEM 9 STAFF ORIGINATOR: Mary Kay Wyland DATE: June 28, 1999 TOPIC: Oasis Market/Amoco, 7509 Lake Drive, Amended Conditional Use Permit VOTE REQUIRED: Simple Majority BACKGROUND The City issued a conditional use permit in May of 1992 to raze and rebuild the Fina Mart at 7509 Lake Drive. This permit was extended in April of 1993 and again in 1994. Permits were finally issued for the construction in August of 1995. Twin Cities Stores Inc., DBA Oasis Markets is the current owner of the property and is requesting this Amended Conditional Use Permit to allow two additional gas pumps to be located on the Lake Drive side of the building. These gas pumps were shown as "future pumps" on the originally approved site plan. Several months ago City Staff spoke with the Oasis Market Manager and a representative of the petroleum company concerning this expansion and advised them both that action by the City was necessary for this expansion. The manager and petroleum representative are no longer with the respective companies and consequently failed to communicate this requirement to the appropriate parties. City Staff noticed the construction early this spring and stopped the work until the appropriate city approval could be received, Therefore, this application is before you The pumps are in place but are not in operation pending approval. Staff has reviewed the request and would recommend approval of the additional pumps. There appears to be adequate maneuvering space in this location and no parking will be displaced. We do, however, have some other concerns that need to be addressed. TRUCK PARKING: When the permit was issued in 1992 to raze and reconstruct there was discussion concerning truck and trailer parking on the site At that time, the owners representative assured the City Council that signs would be placed indicating a two hour maximum limit on the parking of trucks on the site Staff has received numerous complaints from the adjoining property owners concerning the parking of trucks and the storage of trailers on the rear of the property. Trailers are often left unattached with their refrigeration units manning for hours and days, especially on holiday weeks. Mr. and Mrs. Skoglund indicated that over the recent Memorial Day Weekend ten (10) trailers were left parked on the site, only two with the tractor units attached. This, has been a continual problem on the site and the present and past management have been unsuccessful in curbing the problem. Additionally, no sign is apparent on the site.
