• <br />• <br />AGENDA ITEM 5 F 1 (revised) <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: September 13, 1999 <br />TOPIC: Oasis Market /Amoco, 7509 Lake Drive, <br />Amended Conditional Use Permit <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />This item was discussed at the 9/8/99 Work Session. We have contacted the applicant <br />who agreed to continue the discussion to the 9/22/99 Work Session and 9/27/99 Council <br />meeting. <br />Staff has discussed the matter with the City Attorney and explained that the issues <br />include: <br />1. Parking of tractor /trailer units on the site for extended periods of time. <br />2. Noise and diesel fumes from the parked units. <br />3. Enforcement of any parking limitations. <br />4. Possible revocation of the CUP for violations. <br />5. Possibility of an ordinance prohibit parking of certain types of vehicles. <br />Mr. Hawkins indicated that we could impose parking restrictions as a condition of <br />approval for this amended CUP and /or limit the number of spaces provided for said <br />parking. He indicated enforcement would involve notification of any violation to the <br />owner with a time period provided for correction, then notification from the City <br />Attorney that violation must cease or a criminal citation would be issued with further <br />court prosecution. The citation and prosecution would involve the holder of the CUP, not <br />the individual truckers. <br />We will be prepared to review these issues with the Council at the next work session. In <br />the interim we would like to continue this item to the 9/27/99 Council meeting. <br />RECOMMENDATION: <br />Continue to 9/27/99 City Council Meeting <br />
