• <br />• <br />2 <br />• I intend to re- install an above - ground pool, which will be re- located from my previous <br />yard. With the addition of a 6-foot fence, children passing my property will not be tempted <br />to trespass into my yard, as it would be more difficult to even see the pool through a 6 -foot <br />privacy fence, versus a short 4-foot fence. Lino Lakes already requires that pools must be <br />fenced, to prevent access from children. Children can readily climb over 4 -foot fences. A <br />6-foot privacy fence would be quite difficult. <br />• There are currently no trees or shrubs planted along Holly Drive to offer any privacy <br />whatsoever while using the backyard for any personal entertainment activities. <br />• There is a current plan for a walking trail to be installed on Holly Drive, along this property, <br />which further invades any right of privacy. <br />• Eastbound traffic on Holly Drive travels along a curve in the road, west of this property – <br />which provides drivers with a full -view of the entire side and rear yard. In the evenings, the <br />yard would be lit up from the glaring (and aggravating) headlights, exiting this curve. <br />• The privacy fence will be a noise buffer from the traffic, using Holly Drive West. Currently, <br />the south side of "Trapper's Crossing" is being developed with the addition of another 86 <br />homes, plus "Peregrine Pass" has another 9 homes — averaging about an additional 190 <br />cars a day, using Holly Drive as their main thoroughfare. (Two cars per household.) Just <br />driving back and forth to work only, at a minimum, is another 380 cars— on top of the <br />existing traffic volumes from "North Trapper's Crossing" and "Brandywood ". <br />2. That the plight of the landowner is due to the physical circumstances unique to her <br />property, not created by the landowner. <br />The physical circumstances were created by the developer, when the plat was designed – not <br />myself. I could not afford any of the other lots, with my income level. This lot was the most <br />inexpensive one in this particular development – the majority of the other lots have sold for about <br />$15,000 more than this lot's asking price. This lot is similar to what other lower -priced lots currently <br />sell for in Lino Lakes. I was aware of it being a comer lot, but had assumed that the installation of a <br />six -foot fence would provide the needed privacy from the street and pedestrian traffic, and noises <br />associated with them. <br />3. That the hardship is not due to economic considerations alone, and when a reasonable use <br />for the property exists under the terms of the ordinance. <br />The hardship is due to the original plat design, not economics. There is no current landscaping <br />buffer (provided by the Gemini Estates developer) from the main road (Holly Drive). Other <br />developments have had evergreen trees planted, privacy fences installed, or berms created, all paid <br />for by those particular developers. <br />4. The granting of the variance requested will not confer on the applicant, any special <br />privilege that would be denied by this ordinance to other lands, structures, or buildings in <br />the same district. <br />Other applicants with similar circumstances could request a variance consideration. The 6 -foot <br />high privacy fence would begin at the typical front comer of the house, as in any normal side yard, <br />under the current city ordinance. <br />Under current city policy, my official property comer is located about 15 feet from the street <br />pavement. There is also an additional city easement of 40 feet – increasing the distance to 55 feet <br />from the street pavement. Just by briefly driving around Lino Lakes, I noticed these similar privacy - <br />fencing discrepancies (photos included) that were previously permitted by the city for other comer Tots' <br />permits, which did not have to be located 55 feet from the curb. <br />• About 100 feet from my lot, 6401 Trapper's Crossing North (Trapper's Crossing North & Holly <br />Drive) has a six -foot privacy fence, which ends 15 feet from the Holly Drive street pavement. It <br />would be more aesthetically- pleasing to have both privacy fences on each side of the same Holly <br />Drive property, to be similar in length and location. <br />• There is a property at 7154 Mourning Dove Road (comer of Mourning Dove & Sunflower) whose <br />6-foot privacy fence extends 15 feet from Sunflower's street curb. <br />
