• <br />3 <br />• There are 2 properties at 7174 & 7180 Sunfish Court (comer of Elm St. & 2nd Ave.), whose 6- <br />foot rear privacy fences extend 17 feet from the 2nd Ave. curb. <br />• There is a property at 6692 Blue Heron Drive (comer of Hodgeson Road & Blue Heron Drive) <br />whose 6 -foot privacy fence is located 23 feet from Hodqeson's pavement, not 55 feet, even <br />though Hodgeson Road is much busier than Holly Drive. It also has an awkward- looking additional <br />garage installed in the middle of its backyard, which was permitted by the city. <br />• There is property at 405 Ash Street (comer of Ware Road & Ash Street), which has a 6 -foot <br />privacy fence 23 feet from the Ware Road pavement – not 55 feet, even though Ware Road & <br />Ash St. both are significantly busier than Holly Drive. <br />5. That the proposed actions will be in keeping with the spirit and intent of the ordinance. <br />The spirit and intent of the ordinance provides for single family use of the property, by providing some <br />privacy to this lot — and for other reasons as stated in this document. I am not asking for anything <br />special, beyond what other property owners have been previously given permission to by the city, <br />regarding their privacy fence installation. <br />I have discussed the proposed fence construction with my one future neighbor (Brian <br />Mickelsen), who will own the abutting property on my rear lot line (1101 Holly Drive West). He has <br />indicated no objection to the proposed variance. <br />It does not appear that the proposed variance would cause a visibility problem at the intersection of <br />Holly Drive and Cassiopeia Court. <br />• Any potential visibility concems with the nearby curve on Holly Drive is nonexistent, as the curve <br />itself is located westerly on the opposite side of Cassiopeia Court. <br />• The 6 -foot section of fence would begin about 55 feet from the Cassiopeia Street curb — and not <br />be located immediately next to the east side of the intersection. <br />• There would still be another 1 -plus car lengths beyond the 6 -foot fence's edge, of un- obscured <br />visibility for any cars stopping at this intersection, to tum onto Holly Drive. <br />• The project's traffic volume is very low. There are only 8 other homes on the Cassiopeia Court cul- <br />de -sac, so just a minimal number of cars would even be using this street intersection. <br />• If there should be any fence installed in the side yard at the front of the house, it will only be only <br />four feet high, and composed of chain -link. Therefore it wouldn't obscure any driver's line -of- sight, <br />while looking in an easterly direction up Holly Drive. <br />The city already has about a 15 foot easement from the Holly Drive pavement edge, which I have to <br />pay to sod and later mow, although it would be outside the boundaries of any fence, should I install <br />one. Isn't that 15 feet enough? Why does the city need another 40 feet, for a total of 55 feet from the <br />curb? It is a restricted cul-de -sac road in a residential area. What big plans could the city possibly <br />have to require such a large easement near here? <br />I believe that my request is reasonable, qualified and justified under the city's description of a <br />variance. Being the initiator of the variance, I would naturally recommend that the city grants me its <br />approval. <br />My fence needs to be installed prior to my moving into 6408 Cassiopeia Court, otherwise I <br />have no place to keep my one large outdoor (and non - house - trained) dog — my only "farm pet" left <br />from the disintegration of our many years living on our Holly Drive hobby farm. <br />• Thank you for your time. <br />Respectfully, <br />Sue Walseth <br />
