That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. 5. That the proposed actions will be in keeping with the spirit and intent of the ordinance. Staff supports setback variances for the building and parking lot and for the number of parking spaces because of the physical constraints of the site. PLANNING & ZONING BOARD RECOMMENDATION At the April 14 meeting, the P & Z recommended approval of the application with conditions (which are attached to this report for information purposes). Some of those conditions have been met, the plan site plan has been amended, and additional review resulted in more complete and accurate information. These factors have led staff to amend our recommended conditions of approval. • CONDITIONS OF APPROVAL: Site Plan and Variances If the City Council approves the project, staff recommends that the following conditions should apply to the site plan and variances: 1. Proper building permits must be obtained prior to any construction and 1% of the construction costs must be put in escrow to insure completion of all site improvements. A fire sprinkler system is required. 2. New information describing exterior lighting must be submitted and obtain approval by City staff, including the CSO, prior to issuance of building permits. Lighting shall be shielded and not direct light up or out. Wall pack fixtures are not acceptable. 3. The sign in the County right of way must continue to comply with County agreement conditions and the City sign ordinance. Any new signage shall conform to the sign ordinance and proper permits obtained. 4. All permits /approval required by the Rice Creek Watershed District, including drainage and grading and wetland delineation, shall be obtained prior to any site grading. •
