That the hardship is not due to economic considerations alone and when a reasonable <br />use for the property exists under the terms of the ordinance. <br />4. That granting the variance requested will not confer on the applicant any special <br />privilege that would be denied by this ordinance to other lands, structures, or <br />buildings in the same district. <br />5. That the proposed actions will be in keeping with the spirit and intent of the <br />ordinance. <br />Staff supports setback variances for the building and parking lot and for the number of <br />parking spaces because of the physical constraints of the site. <br />PLANNING & ZONING BOARD RECOMMENDATION <br />At the April 14 meeting, the P & Z recommended approval of the application with <br />conditions (which are attached to this report for information purposes). Some of those <br />conditions have been met, the plan site plan has been amended, and additional review <br />resulted in more complete and accurate information. These factors have led staff to <br />amend our recommended conditions of approval. <br />• <br />CONDITIONS OF APPROVAL: Site Plan and Variances <br />If the City Council approves the project, staff recommends that the following conditions <br />should apply to the site plan and variances: <br />1. Proper building permits must be obtained prior to any construction and 1% of the <br />construction costs must be put in escrow to insure completion of all site <br />improvements. A fire sprinkler system is required. <br />2. New information describing exterior lighting must be submitted and obtain approval <br />by City staff, including the CSO, prior to issuance of building permits. Lighting shall <br />be shielded and not direct light up or out. Wall pack fixtures are not acceptable. <br />3. The sign in the County right of way must continue to comply with County agreement <br />conditions and the City sign ordinance. Any new signage shall conform to the sign <br />ordinance and proper permits obtained. <br />4. All permits /approval required by the Rice Creek Watershed District, including <br />drainage and grading and wetland delineation, shall be obtained prior to any site <br />grading. <br />• <br />
