Our Charter <br />requires that all conveyances of real estate by the City be accomplished by ordinance. <br />This requires a first reading, a second reading and publication. The first reading is <br />scheduled for Monday evening. The reconveyance of this property to Mr. Vaughan is <br />a term of the settlement and something we are obligated to do. <br />It is not possible for either party to back out of the settlement or attempt to alter the <br />terms of the settlement. Consequently, for example, Mr. Vaughan cannot decline to <br />accept the reconveyed property and elect to receive money damages in lieu of the <br />property. Once the ordinance has been approved and published, the deed can be <br />executed, recorded and the settlement completed. <br />Mr. Hawkins will attend the City Council meeting Monday evening to further explain <br />the settlement and to answer any questions that the Council or staff may have with <br />respect to the settlement. <br />Thank you for your attention to this matter.
